  • Here's a question: I understand that under Section 56, Schedule 4 of PoFA only land owners who are members of a Government Accredited Trade Association i.e., the BPA can request details of the registered keeper from the DVLA. I also understand that membership of the BPA is subject to being in adherence with the BPAs Code of Practice.

    Could it be argued that if ParkingEye are not in compliance with the Code of Practice then they have no right to seek the registered keeper's details from the DVLA? Consequently can it be argued that they have no right to pursue any charge against the registered keeper?
