    I think I’ll re-write my letter as you suggest in post 45. All the research and information I’ve gathered may be very useful later on, and the other letter I have may then be needed.

    This all feels like a nightmare world I never meant to get caught up in!! I wasn’t intending this week to spend such a huge amount of time finding out about Court procedures and Practice direction… On one hand its really interesting reading! The more I read up on it the more angry I feel about the way PE and others are treating people. I’ve been talking with lots of people about it and its been suggested I write to my MP, Watchdog, Radio 4 and other places….
    Am sure lots of people have done that too but the more pressure I guess…

    Hi appletreetop, just remember bullies and cowards shout the loudest. Their whole modus operandii is scare tactics and intimidation, and their latest letter is just another development of this.

    Take which ever route you feel the most comfortable with - that's the point of having two options. I doubt very much that they will provide the PD information as winning in court depends on the defendant NOT understanding the case against them. But you just need to keep the dance going and reply within the time limits - so do send yr letter within the 14 days.

    Come back when you get a reply from them.

    I think most of us started out this way, never wanting to be involved in any of this sh/te. I didn't directly, but it did galvanise me into getting clued up and then helping with the fight-back. From information gleaned from here and PepiPoo I got rid of a charge and a monkey off a back. Maybe one day I'll reveal the full story, but it has caused some waves around the system.

    The more people who get 'caught up' and seek advice on the forums, the more who will avoid this stuff in the future and the more who will be better informed about how to fight this. As a minimum, beating the PPC at POPLA, perhaps also informing friends and family, maybe even getting to the point of being more involved in the forums beyond their own particular case.

    In whatever way, each action further eats away at the PPC business model and moves this country nearer to ridding the cancer.

    PPCs have got hold of the tiger by the tail - not the best place in the world to be!

  • Thanks for all this, letter has been sent and I’ll keep the dance going…

    In the meantime I’m trying to get clued up about it all and to spread the word about the PPC model… Things like making a choice about where to shop depending on how the car park is “managed” seems to already be in the heads of lots of people I know…

    Thanks again, its amazing what you inadvertently find yourself caught up in! But I’m a great believer in having as much information as you can in life! :)

    Had 2 letters from Debtrecovery plus the second one starts by saying "notice of intended court action".Is this the same as the notice of action letter or is that the next one?

  • Hi, just wanted to add an update for my situation. I’ve had the standard several pages long letter reply from PE to my letter after I got their Letter Before Action. It’s the same letter that is found on several other postings on this forum, so I knew exactly what to expect.

    I’ve been keeping an eye on the situation with all of this and reading lots of posts on here and on Pepipoo. Understandably no-one can quite say what might happen next in terms of court cases and further action etc. I’m so very busy at the moment and have so many complicated things going on in my life (as many people do) and my time is just so limited; after weighing it all up and lots of careful consideration I decided that I just couldn’t afford the time it would take to defend court summons etc. So, much as I hate them I have paid PE just in order to give me time to focus on other things that are incredibly pressing. Something had to give for me…

    I know this is a fight back forum and I think you are all doing amazing work and I want to really thank everyone so much for all of their help. I especially wanted to say thank you to Daisy and hope you are getting better.

    I’ve spoken with loads of people about the PE situation and been spreading the word about it all and about this forum so that people know where to turn for good advice. The more I look the more I come across car parks where PE are in place and the more I know people will be caught out by them and they need to know about popla and how to approach different shops etc to voice concerns.

    One of the things the whole situation has highlighted for me is the huge gaps there are between businesses who are out to scam, frighten, harass and intimidate people in order to make money – and then on the flip side are the individual people who work to make the world a place of good feelings, who help and who fight, who defend and who offer their advice.

    I may have taken the path of least resistance with PE this time in order to focus on other pressing things, but it doesn’t mean I won’t keep finding ways to highlight their awful practice. I also just want again to thank everyone on here for all their advice and for being a voice of support, hope, good wishes and strength. You are doing really amazing stuff and I really respect what you do. :A :T :T

    Hi, thanks for coming back and updating us. I agree, it is time consuming and potentially stressful playing ping-pong with these scammers, and while many of us would fight them to the bitter end, I would never criticise anyone for making a pragmatic decision to pay them off and get on with your life.

    On the plus side - if you ever get another PCN, you'll know to appeal and get them off your back from the outset.

    If I had more time and energy on my hands at present I would have fought Parking Eye further – they really do deserve to be brought to answer many questions.

    I really respect anyone who does take it as far as possible because I can see just how many vulnerable people are being caught up in all of the PPC issues.

    I know I’ve had to make a decision to bow out of dealing directly with PE this time; but you’re right – at least now I feel very well informed about the procedures and appeals / POPLA etc. In the past few months I’ve ended up talking to loads of people about it and trying to spread the word about ways to tackle it all.

    I have also found everything I’ve read about court procedures, LBA, how the PD works etc interesting (just lengthy reading!). I would urge anyone to read up on stuff and get to know their rights and how systems work – its always best to have as much information as you can.

    We would never try and force people in doing something they don't want to do, if you are going to pay them, why not offer the reduced sum in full and final settlement, they may just take it and it will save yourself a few quid.

    As Daisy said next it happens come back here for advice.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
