Please help, advice needed

In feb this yr i ordered 500 litres of heating oil and paid in full over the phone before delivery. I was out when it was delivered and the driver gave me 1000 litres instead of the 500 i ordered. It said on the delivery slip "meter over counted, please ring Watsons"
I rang them and told them i hadnt ordered it because i couldnt afford to pay for it, please come suck in out. They said they would defer payment till the end of may. i said it was a waste of time coz i still wouldnt have the money to pay for it then.
They now ring me daily. on sat i recieved a letter saying they were seeking a ccj for none payment of £356.
I have wrote to them repeating what i said on the phone but they keep ringing.
What rights do i have? i am worried sick x
Dear Lord,so far today i am doing alright. i have not lost my temper, been selfish or rude.i have not cursed, whined or eaten any chocolate. HOWEVER, i will be getting out of bed in a minute and i will need a lot more help after that...amen

Go to court and defend the action. How can they possibly win if you made it clear in writing that you did not want the extra 500l, even with a deferred payment?
No free lunch, and no free laptop ;)
  • the letter they sent made it sound like they can do the ccj without me? does it go to court then?

Yes they can, but upon arrival of said CCJ you have 14 days, I think, to put your case, before anything is issued by the court.
  • Thank you xx
