Direct Debit Indemnity Claims

  • Hi I am new to site and long time since someone commented on this topic.

    I am about to complete with my Bank a few indemnity claims through Direct Debit Guarantee. Mainly because the Phone Company I am with have failed to provide me with my monthly bill since March 2013!

    I was told by Phone Company that 'yes I can make an indemnity claim through my Bank but that I would then have to pay this back to said Phone Company.

    Is this right that it would have to be paid back?

    Yes. They would deduct the sum repaid to you from the company it was paid to, who could then bill you for the outstanding amount, or disconnect you until you paid the sum demanded.

    Yes of course there is no free lunch here - you enter into a contract for a service to be provided and you pay for that service.
    The direct debit indemnity will re credit your bank account but does not absolve you from paying for said service.

    Yes, they should have informed you about the amount before taking money by the DD and this can be a valid reason for claiming money back under the DD guarantee. However, you still owe them the money and have to pay what you owe.
