    The dd indemnity claim is straight away, if the bank fill in an indemnity claim form they refund the customer straightaway, then the Bank goes to the company to claim the money, by send ing the indemnity form to the company, if the company do not pay the bank within whatever time frame the bank works to, the bank will then automatically deduct the money from the company to pay themselves back. Then the company loses the money. The dd guarantee is an indemnity, been working with indemnities for over twenty years.!! if you had a rolling contract with a gym, cancelling the dd is not enough, you would have had to send a letter to the gym at the same time. The banks always say when you cancel a DD make sure you tell the company that the DD is for. You can claim back 6 years, which is normally the length of time the banks hold the direct debits mandates for.
  • I have today spoken to Santander and they are advising me that they can only claim back 3 months and therefore I cannot claim my September payments via the Direct Debit Guarantee Scheme. Does anyone have any facts on this matter? This is for a home insurance policy which was not renewed and called via the company and they continued to claim the monies from my bank account.

  • I have been a victim of internet fraud. I bought digital camera from eJaffa.com and paid for it through Paypal which takes the money from my bank acount by direct debit. The camera did not come. I made a claim through Paypal for a refund. Although Paypal found in my favour they could not get any money back from eJaffa so no refund! Does anyone know if the Direct Debit Guarantee in this thread would apply in my case and I could get my bank to refund my money? I have not asked them yet!

    Your post says it all. PayPal are nothing but cheats, if ejaffa withdrew the money from paypal, thats Paypal's problem, not yours. I would advise anyone NEVER USE PAYPAL! Always pay a website who accept credit cards directly. To obtain a proper merchant account takes weeks of aplication, we have been using BOS merchant services now for 2 years and that took 4 weeks to setup, we needed to produce a full business plan and undergo credit checks. We just changed to Barclaycard merchant services and that has been an 8 week process.
    Tom, !!!!!! and Harry can all setup a Paypal account in 30 seconds and accept payments on a bogus website within minutes.

    No matter what paypal say, They are NOT secure and offer no protection to anyone apart from themselves. Always pay an internet merchant directly using your Credit card and if anything goes wrong, under the consumer credit act, your card issuer will compensate you.

    What has this got to do with Direct debit guarantee? well I admit, nothing but when I saw that comment about PayPal, I just had to take 5 minutes out to warn people about them.

    A bit broad, the credit card company is jointly liable subject to Section 75, ie if the items is over £100 and doesn't meet Sale of Goods Act criteria, they won't refund a £10 item, just because it doesn't fit (for example)

    That's good of you. But as the post you're commenting on is 2 years old .... it's not a very timely warning.

  • I have tried to claim back a direct debit through my bank for a health club membership which was cancelled over two years ago, my bank have told me today that they have contacted the club in question by telephone and the club are saying that the DD was never cancelled so they cannot reimburse me. Is this correct? Can the bank contact the DD originator by telephone? Help!

    If the gym are denying you cancelled the membership with them the bank are entirely within their rights to not pay out under the Direct Debit Guarantee as no error has been made - unless you can prove otherwise.

    The Guarantee does not circumvent any contractual obligations you have with the gym.
    Anything I post is my opinion, so from time to time I may be wrong. I try to provide answers based in fact, however I don't know everything, so (like all posters on MSE), take what I say with a pinch of salt.

    When you cancel a membership or contract like this, make sure you cancel the direct debit with the bank. That would have avoided your problem.
  • Hi,
    I recently mad a purchase on eBay and paid via Paypal (Direct Debit from my bank account). The item I received was no good and I sent it back (seller confirmed receipt) but I haven't received a refund and the seller ignores my mails.
    Normally I ensure I am paying by Credit Card to PayPal but didn't on this occasion. Can I claim back the money under the Direct Debit Guarantee?
