I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.
  • If I've not heard anything from POPLA and my appeal date was early October does that mean I won?!
Reading other posts many people have clearly had a letter outlining the outcome but I've had nothing.
Not sure whether to breathe a sigh of relief yet!
    Thanks

Email POPLA and ask for an update. I did and was told my successful appeal had been emailed to me a few days earlier but I had never received it. They promptly emailed another copy.

    Don't assume anything!!
  • Emailed them and had a reply saying my appeal hasn't been heard yet!
I can't find any information that says if popla has to consider the appeal within a certain time, the letter I had says on or as soon after the given date. It's been 2 months now but maybe it's normal to take so long.

I wouldn't think they're too far away from doing yours now. They've had huge backlogs, but have recruited more Assessors and now seem to be getting the pile down
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

We've seen some where the papers were seemingly forgotten in a drawer because the PPC never supplied the evidence, then when followed up by the motorist, POPLA dug it out and made a decision within a week!

  • Just to let the forum know that I've won the appeal. The only reason given was that the assessor did not consider the charge to be equal to any estimated loss for Parking Eye.
A big thank-you to all of you who helped me out with all my queries and to those of you whose previous posts & outcomes I was able to learn from.

Can you copy your appeal result text into the POPLA Decisions thread please?

PS - well done. Another win against PE for No GPEoL. :)

Please post it up in the POPLA Decisions sticky thread as we must be close to 100 wins v Parking Eye on 'not a genuine pre-estimate of loss' alone.
