Why bother with an appeal? Surely it means you acknowledge their authority and are asking them to reconsider. I'm so tempted to write back and say '!!!! off you chancy !!!!!!!, crawl back under your stone.'

Why not wait for the court appearance, if you're lucky, and embarrass the !!!! out of them, and claim for your defence solicitor and your time, inconvenience and loss of earnings. Is it just me that gets so riled up with these low-life pond-dwellers?
Sorry, I haven't made myself clear. I wasn't referring to the original OP, I meant in every parking charge issued in general. Why should we feel the need to buy a stamp? Please re-read my original post above, and give me your opinion re that.

I have read your post, a private parking company has no authority at all ! The reason to appeal in this instance is because CEL issue claims and they are doing a fair few of them right now. We try and advise on each post on its merits, simply saying ignore in England and Wales is not always going to the right choice.

And the whole point of the small claims is to do it without solicitors, their costs will outweigh any claim so you might as well pay it. You will be limited on loss of wages as its likely there won't be any as you would take annual leave.
When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.

Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

The idea of going down the Popla route is that a well-written appeal to them has a higher chance of getting accepted, and it costs the scammers money.

So you're advocating that I should donate some of my annual leave to defend a case where there is no case? I'm self employed so it might be cheaper to pay the penalty and work the day instead.

You will still be limited even if you are self employed. That is the reality of the small claims. That is why in cases where CEL or Paring Eye are concerned its probably better to challenge it and go through popla if needed.

And as for paying that is of course an option, its your money and if you want to fund a scam go and pay it ! But FYI its not a penalty/fine and no offence or illegality is involved.

The object for anyone should be to retain their money and not at these ridiculous charges - I.e. money saving.

Entering the lottery of a court judging a case with attendant costs even if you win should be avoided if at all possible. POPLA gives you that opportunity, particular lay with free help from here and pepipoo. And it costs the PPC in time and real money, even if they win.

Okay thought it was them, please don't anything further on this website in regards to the details of this as they monitor this website. I would challenge this now as CEL do make small claims, so rather than waiting and see if they choose you circumvent that by sending a soft appeal like the one below. No matter what you write they will reject

    Name
    Address

    Date

    Dear Scammers,

In regards to the invoice received with ref number xxxxxx dated xxxxxx, the keeper denies all liability to your company, if you reject this appeal the keeper requires within 35 days a popla verification code for them to appeal independently, per Version 2 of the BPA Code of Practice.

The keeper has nothing further to add and refuses to enter into your protracted appeals, and will not respond to any correspondence from your company unless it contains the popla code. If you wish to find out why the keeper rejects all liability, pay the £27 plus vat to popla to find out

The appeal will be deemed accepted if there is no popla code on any rejection that you supply within the timeframe stipulated above.

    Yours Faithfully

    Your name (printed)

    Hi,

I recently got a parking charge notice from CEL also. For this period i didn't even get out of my car, I was waiting in the area for 25 mins as there were no available spaces to park whatsoever and following a failed attempt at parking moved swiftly on. CEL have now attempted to charge me £75 in 14 days or £150 in 28 days for the pleasure of not being able to find a space in their carpark.

Do you advise me to do the same thing and write them this letter? This is the first time i've really appealed or repudiated something like this so am quite nervous in doing so as I'm not exactly sure of my rights, but I really don't feel as though i should be paying £75 to these people when I couldn't even park there if i wanted to!

Any help would be really appreciated.

    Many thanks

Please copy and paste your query into a new thread of your own, as any advice given on this thread won't be clear as to whether it applies to you or the OP. This may lead to confusion and poasible (costly) errors.

You'll get plenty of bespoke help on your own thread.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
