How do I know if EA has actually put my offer to vendor?

    Is sending the letters out part of a scheme some estate agents choose to be past of? I have sold my house and recieved a letter informing me I had accepted an offer for my home but that was it. Buyer im also convinced the seller knows nothing about me, however I now know a family member related to the seller so I may do abit of digging first. lol
    I hope that my child, looking back on today
    Will remember a mother who had time to play;
    Because children grow up while you're not looking,
    There are years ahead for cleaning and cooking.

    It can be enforced by either The Office of Fair Trading or Trading Standards, if EA's do not comply with the Act then then can be banned from trading as an EA and if you ignore then ban you can be prosecuted and fined!

    I have known EA's in my career that have been banned, so I know that the OFT take matters like not informing vendors of offers seriously.

    If anyone seriously suspects that offers are not being reported to vendors then they need to report it!
    My home is usually the House Buying, Renting and Selling Forum where I can be found trying to (sometimes unsucessfully) prove that not all Estate Agents are crooks. With 20 years experience of Sales/Lettings and having bought and sold many of my own properties I've usually got something to say ;)

  • Hi, it's my first post so here goes.

    EA's DO NOT have to provide the purchaser with a confirmation of offer. Any that do are following best practice.
    EA's Do have to inform the seller of any offer in writing. Generally they phone as well.

    My Advice to you is:

    a) Always speak to the manager from now on.
    b) Whilst talking ask about any other buying services they offer. (Don't use any they are a rip off) It's just some agents prefer a buyer who use their mortgage services / Conveyancing / removals etc. book an appointment go through with it or cancel when your offer is accepted.
    c) Use the address you got as a last resort the EA will not like you going behind their back.
    d) Re-confirm your offer in writing. This time ask for a copy of any correspondence about your offer.
    e) Provide everything in your letter solicitors, surveyor, mortgage, your chain or buying position, how quick you can be and include similar properties at the 250k mark to let the purchaser know how you came to your decision.
    f) Ask the agent to respond to you in writing within 24hours.

    If you still get no joy, use the vendors address you have. Forward copies of all the agent paperwork this time. In a covering letter you could also get the vendor to re-negotiate the agency fees (if the agent did not forward the offer) hopefully saving you more money on the asking price.

    This will backfire if the seller is a friend of the agent or the owner. Or the vendor specifically asked not to be informed of offers below a certain amount.

    Generally agents want to do the deal so it could be that 250k simply isn't enough. If you could stretch to 260k ask the vendor to pay the stamp duty or even just 2% of it. Or stick to your guns and play the waiting game.
