Mbna help please

Hi all I have decided to challenge MBNA on behalf of my hubby as I had a feeling going back years now that he had been unfairly charged on his credit card. I have contacted them and they have sent out a print out of transactions from apr 2006 until oct 2010.

I do know he tried paying it and it became a mass of charges etc it ended up I believe at a debt collection agency.

Anyways here is a breakdown from what I can make out

LATE FEE'S TOTAL £241
POSTED RETAIL INTEREST? £1228.15
LATE FEE ADJ? £25
POSTED CASH ADVANCE FEES? £42
FINANCE CHARGES £424.82
INTEREST ADJ? £60.95
LATE FEE FOR RETURNED PAYMENT PYT £12
OVERLIMIT FEE ON BALANCE £252
RETURN PAYMENT FEE £48
POSTED CASH ADVANCE INTEREST £55.015

TOTAL CHARGES £2388.935


To be honest its all very confusing as
He spent £3181.65. retail online shopping and bills etc...
Via Lloyds TSB he paid in total £ 4713.21
to Mackenzie hall ltd he paid a further £1633.69.


Is it just me or does this not make any sense. Does he have a claim for any of these charges
Should I just sent this paperwork to the ombudsman and let them figure it out. None of the figures if I really went into what it says makes any sense at all.

He has no clue what any of these charges are for. The card was started in april 2006 his last time using the card was December 2006. from December 2006 until October 2008 is all they have gave me in paperwork. He is sure he didn't ask for any PPI on it is that something that can be on here under another name.

can anyone help a very puzzled wifey :rotfl:

    You could try claiming anything that is listed as a fee. Where is the PPI listed ?

    If the debt was passed to Mackenzie Hall then any refund (if made) will probably be passed to them to off set against the debt.
  • Thats the thing i dont know what these fees are was just saying for anyone who wondered he didnt ask for any PPI, just in case one of these is it. We havent had anything via post from anyone since 2008 as he feels or is certain he paid it all off. I took this on myself as i felt it should be looked at. He is just upset that he got into that sort of mess. Once i started looking into a picture loan i checked on experian and mbna popped up. I remembered the stress it caused him n no matter what he paid loads more fees went on top so he let it slip. But once i looked through what paperwork they sent i was alarmed at the amount of charges upon charges. Its like they charged him for late fees via DD's that they set up and fees in late fees in late fees etc etc. in not surprized he kept all this to himself. But even tho i have spent 2 days beating my calculator up no figures make sense. I guess if i send it all off perhaps a proffessional can go over it. Do you think any of this is PPI? I havent a clue. I just find the charges were severe and prob contributed to his running up the arrears in the first place.
  • I do remember he requested a settlement figure he has paid it off to mackenzie hall ltd. but i remember when he paid the £3g to mbna directly apart from dds and other payments that was it and then it started with tje debt collections saying oh no you now owe this. Its madness.

    As meer53 suggests, you could try claiming for anything listed as a fee. (Interest, etc is not normally refundable)

    This article explains more, especially with regards to late payment and overlimit fees

    Are any of the individual late payment or overlimit fees in excess of £12? If so then they will probably be refunded with ease (or at least the difference in what was charged and £12). If not, I'm sure the FOS will help you recover this.

    However, any individual late payment or over limit fees of £12 or less may require you to go to court to get the judge to assess the unfairness you claim; success is not guaranteed (and even if you are successful, you may only get back the difference between what the judge agrees is fair and the amount paid)
    The FOS will not help you in this regard.
    Returned payment fees may also require a court judge to adjudicate on the fairness or otherwise.
    I would strongly urge you to seek independent legal advice before pursuing this in court.

    Note, also, you can only go to the FOS after you have exhausted the card provider's own complaints procedure (and before any legal proceedings commence)

He was paying some months £185 and then they would really lay on the charges i feel they kept him in debt and added more n more fees. He was do upset with all of it. Yes he spent on it but he paid every month until it just got out of control. Only today i showed him the breakdown iv been given he was pretty silent. I just wish we had guts at the time to say enough is enough. I have sent iff an email and letter today asking for it to be refunded as the mse template suggests. Lets hope they do the right thing by him this time.

    It's not a case of them doing the right thing by him, they haven't done anything wrong. They will probably want to know why you've only just decided to query these charges and haven't queried them before now. Your husband really should have taken some action at the time, there might have been a bit more help for him and a bit more sympathy. Charges are only applied when a payment is late or the account goes over the limit, it was your husbands responsibility to manage the account, not the banks.
  • Yes very true tbh at the time i think it just got out of control. What annoys me is yes he should have dealt with rather than stick his head in sand. But i do feel they contributed to him failing to keep up with the demands by excessive charge after charge. Safe to say hes never had a CC ever since. Fingers burnt. It was only has i am dealing with a loan ppi the mbna was one i wanted to investigate. And now i can see just why he ran away from it.
  • If i can add sorry they pushed him over his limit with fees and charges and then fined him weekly for them adding the fine in the first place. He was paying twice the minimum a mth sometimes more. But they would put on 4/5 fees,charges plus interest on top of that. If that makes sense.

    I'm not sure MBNA levey any charge of £80 (except perhaps for a personal visit etc). The total monthly charges accumulated is irrelevent (as long as it is in line with their tariff of such charges).

    You would be wise to double check those actual charges and what they were for.

    However, as I posted previously, if MBNA have charged you a single charge of £80 for exceding the credit limit, or paying late, then it will be quite easy to get at least £68 of that charge refunded :)
    Likewise for a single charge of £25 for either of the previously mentioned 'offences', it would be easy to recover at least £13.

    They may even refund you more than the amounts I suggest. Just follow the MSE guide ... but only after you have checked and confirmed your facts.

    Hi there sorry just got back online. Not sure what you mean exactly by levey?. sorry. Personal visits do you mean bailiffs etc, if so that never got to that point with them.

    Card was opened in a Halfords store hubby thought it was for a store card. All he did was sign and give address, card came through the post shocked yes but sadly we used it. Own fault. However I am concerned at the fact he thought it was a store card, no mention of PPI as he was covered through work. that is a diff issue that has been included in my complaint.

    The list of transactions they sent through I can list these for you.

    finance charge these began 12 months after card began?
    £82.76, £92.83, £82.93. these continue for 6 months straight prior to card being paid off.

    other odd payments are for
    posted retail interest
    begins around 4th month in for £8.79 by the last 12 months or so they vary between £32.58 and £83.25 there are 23 of these

    overlimit fee on balance 21 x £12
    late fees 18 x £12 1x£25

    late fee adjustment £25

    posted cash advance fees 14x£3.00
    late fee for returned PYT NSY? £12

    posted cash advance interest varys from £0.85 to £9.99 16 payments to that

    return PM fee??? 4x£12

    ovl fee adj??? £12


    from dec 06 he doesn't uses the card again till its closed. I have sent away a copy of these to the FOS as MBNA are not contacting us. I feel he was conned into the card in the first place at the checkout of Halfords.
