Why not fully on the road?unsure3194 wrote: »I literally pulled up alongside this building half on the path outside and half on the road.0 -
I could have just parked on the road too but it is a quite a small road with buildings either side and paths and other vehicles were parked opposite do I had to put part of the car onto the pavement. The pavement was approx 2.5 meters in width so I was causing no obstructions. Unlike the owner of the premises involved who parks cars fully on the pavement to sell cars!!!0

The pavement is not private land, and despite everything it's got sod all to do with ukcps , what it looks like to me is that it was a self ticket by this company and they are exceeding their authority. On your complaint to trading standards mention the signs that are probably misleading as wellWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

There's a lot of discussion here but the important thing is did they send a POPLA code with the rejection letter?
You say 'my appealS - {plural} - have failed' - why two appeals?
See also this thread to see a bit about appeals and POPLA and where UKCPS hide out at their 'HQ'! See what sort of bunch of chancers you are dealing with here!

HTH and do not word the POPLA appeal without help, you can win this with the right arguments and legal stuff that POPLA seem to like!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The first rejection letter states i can appeal twice to UKCPS, just as long as i have different evidence to what was originally produced.
I have now requested the POPLA ref number to appeal to them but have not received it yet.0 -
Come back for help on popla, don't do it alone. In the meantime you need proof that this is adopted road, and to make a complaint to trading standards, which should be done whether ukcps accept your appeal or not. You should be doing this on as many different angles as possibleWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.

I'm I ok to attach my evidence on here for you to look at. It's nothing that this company haven't seen.
I would mark on the plan where my vehicle was parked. I can remove names and all can be removed.0 -
You don't have to do that we believe you, it's just you need to do this in as many different ways as possible. When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.

Good. UKCPS lie when they say you have to go through a 2 point appeals process with them and to actually ask for that POPLA code. They breach the BPA Code of Practice in this respect as their Notices are not compliant. In particular, their 'Notice to Keeper' version of a demand is absolute pants but as you said you appealed to the first ticket so quickly, maybe you never got that Notice (which is a shame).
Has the store put it in writing that they don't want people to be charged? That would be very useful for your POPLA appeal - and as Stroma said, don't word that stage without help. It's not an appeal like you might think of writing and it's not something to base around one or two points only.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Both the ticket and first letter I got had I could appeal twice before going to Popla. My only thoughts on this are that it's as clear as day that my vehicle was parked on the public highway.
After I produced the land registry evidence showing I was outside the company's boundary I thought they would have seen that this would get kicked into touch if I pushed it so why have they continued to reject my appeal.
The premises is actually a garage which has its own secure yard. I haven't approached them yet. As its ukcps who ticketed the vehicle.0
