    Why should she leave any more than him? In fact she probably has more legal rights if she is looking after the kids.

    If the house is in joint names then some arrangement needs to be made.

    As I hinted at earlier an easy way to exclude you from your own home would be to demonstrate it is inhabited by vulnerable people (ie your spouse and children) and that you are a risk to them it is not uncommon.

    If you are married it does not matter whose name is on the deeds or the rent book. Both have equal rights to the marital home. The passage of time is of no relevance.

    previously i was told by my legal advisor it really does not matter who owns the house when youre married as you both have equal rights to stay in the marital home. But as soon as one leaves the home this can change who has rights. At the end of the day best to seek legal advice. For free advice ring the legal helpline from your house insurance...

    As Atpug said your household contents or builds insurance should have a legal helpline number on the inside cover (front or back) however I don't know how this will work for you if you have a joint policy as with marital affairs there is an obvious "conflict of interests" check your policy, if it is in your name then call them if in joint names or hers I would be wary and try to seek legal advice elsewhere such as CAB or even your Trades Union if you are a member of one as you will almost certainly have free advice to you there.
