Person accidentally damaged my motorbike - where do I stand?

    Not really.

    My insurer doesnt seem to care what happens if i'm not making a claim. Called to tell them i'd been hit by another car/driver and they said I didnt need to tell them unless I was making a claim.

    Premium also came down by about 25% :)

    What is this insurer? I will transfer to them! Seriously! Mine demands that everything is told, any incident at all...

    CIS. Been with them 4 years so far (Direct Line previously - left them after they took the !!!! though - as did the rest of my family).

    I was as surprised as you are, was under the impression you were supposed to tell them, as whether you are making a claim or not or it could invalidate your insurance if you dont declare it as it could affect your risk factor.

    If I was less honest, I wouldve claimed off the guys insurance for whiplash etc :rotfl: He was utterly clueless (hadnt long passed his test).

    I've got the same with mine, also windscreens don't count as claims. Surprised you're all so incredulous!

    Most insist n this nowadays neil. It is always asked have you had any incidents in the last 5 years

    tbh whilst I would be willing to pay for repairs to any damage that I had caused to someone's property, it would grate if I was to give them full whack only for them to put it in their pocket and leave the damage unrepaired.


    (in fact I think I would be tempted to tell you to get the scooter repaired and I would pay the repair bill)

    The OP will likely have to cover the cost at some point though, whether through repairing it or reducing a sale price so the subsequent owner should request it.
    It would be foolish to wait until that time arose to ask for payment, so he is asking for it now.
    The £350 figure has been calculated based on an actual quote for the work, so it's not a figure OP's pulled out of his bum.
    Really, it's none of the woman's business what OP does with the money. A reasonable comlensation value for the damage caused was requested, and OP was even lovely enough not to push for payment until after Christmas. The woman is now SERIOUSLY pushing her luck.

    But if he's not having the work done how can £350 be a 'fair figure'?

    I agree with you that there should be an exchange of cash but I think its wrong to say that a reasonable level of compensation is the quote figure.

    Would it be returning a part of a secondhand bike to new condition? Could a secondhand part and repair be a suitable middle ground?

    Taken from CIS's car insurance policy document:
    Under the conditions of your policy you must tell us about any insurance-related incidents (such as fire, water damage, theft or an accident) whether or not they give rise to a claim.
    So even though the advisor told you one thing it is indeed part of you policy conditions to inform them. I'd stick to what you have in writing if I were you.
