Are 3mobile stealing from me? with false Data charges?

Hey guys,
this is my first post but I dont know where else to turn.
I recently received a bill from 3 with £38 + vat of data charges I did not request.
To cut a long story short, it turns out that when connected via USB, the phone installed a driver called a LAN adapter which was automatically taking over network traffic.
All their customer services will say is that I am liable, and for the life of me I do not know why! I didnt request, initiate, prompt or confirm any connection.
In fact my PC is on a 10Mb lan anyway!
To add further insult to injury, I am now told that to have The option to disable any further automatic connection. I must pay to sign up to their wireless web service so i can then choose to NOT connect! Almost Surreal in its irony!
SO.....I am running around in circles, does anybody have any similar experience or advice on what I should do?

Unfortunately I think you are lumbered with the bill, you could right to 3 and explain that the software you received with the handset did this by default, which i'm pretty sure it shouldn't have. Higher level of customer services may be sympathetic and refund the extra charges.
Which handset is it that you have? to sign up to another service seems pointless.. if anything they must have misunderstood you. May be a matter of adjusting settings on your handset/pcSLC: £13000+
Quidco: £131.24 (paid) + £0 (validated) = £131.24

I find 3 call centres were completely useless.
The Customer Services Director is a chap called IIRC Eric Disney - seems right for a micky mouse organisation!

Hey thanks for the response, the phone is a sony K800i bought from 3, its never been changed in any way. I dont usually connect it to the pc but as I forgot my charger I plugged it in a couple of times to charge over USB.
I am waiting for a call back at the moment but not holding my breath!
I have told them I will NOT pay this charge and if they try to send me to collections will attend the county court to explain.
It just seems so unfair that I have to risk damaging my credit history over these cheeky fellers.
I think I will be writing to the cartoon character soon cheers for that! no wonder they're such clowns.0 -
I simply told them 4 times today im not paying 22pounds for my data usage even if my X series silver & new priceplan was deactivated before a months full service, I used that under xseries silver not my previous billing of web & office casual
( 1pound A MB ) recalculate the bill and remove the billing admin charges, I told you prior to my d/debit date it would be cancelled if it was not sorted out by said d/d date
there as hopeless as hell, hell being (o)2 years of error after errorSO... now England its the Scots turn to say dont leave the UK, stay in Europe with us in the UK, dont let the tories fool you like they did us with empty lies... You will be leaving the UK aswell as Europe0
