The owner / registered keeper is the one who's name is on the V5 document regardless0

No it doesn't! He's not the owner (the finance company is). Lots of insurers don't insure cars where the policy holder is not the legal owner precisely because of this scenario. They legally have to pay the owner, any excess will pass to the person named on the V5 who does not have to give any money to your OH if he doesn't want to.Trying to be a man is a waste of a woman0 -

Odds are there won't be any money left over. The OP's OH may end up owing money (to his brother) for a car he no longer has. Ouch.Trying to be a man is a waste of a woman0

When i got a car on fincance i was asked to take out gap insurance so that i would not be left owing money out if anything happened to the car.0

Oh dear yeah sounds like a void policy to me, if your not the registered keeper and you said you were then that in itself is enough to void the policy.
Let alone the fact the finance is in someone else's name and meaning your boyfriend has no insurable interest and as such no insurance company would have covered him if they had been told the truth when the policy was setup.

If the OP's boyfriend can prove he was repaying his brother every month, then he may be able to justify that it's his car.
