Lost my phone -
I have lost my phone (I was pushed over in a club in midst of a fight tht had broken out next to me... my phone and a few other things fell rom my hand, andwhen the fight was broken up and i could actually look on the floor for it it was gone.)
I have a lot of experience with insurers catching you out with smallprint rules and rejecting claims, for example once it was stolen from my car but they would not give me a new phone because there was no physical damage to the car.
I am not too great with translating legal wording and policies. i use betterbuy insurance and my policy is here: for your reading: http://ameliealden-ukmodel.co.uk/Doc_BetterBuyInsurance.pdf
I have never claimed for loss before, and i imagine this is the greyest of grey areas for insurance. Based on the above and the policy wording linked to above, can anyone more knowledgeable warn me of any little loopholes or rules which will make them reject my loss claim??

I don't know all the ins and outs of these contracts but the first thing that comes to my mind is that they will try to claim that as you were in a club then you were most likely drunk and it was your fault for losing it, or something along those lines. I have heard of this happening to people.0

Did you report it to the police as stolen within 24 hours and get a crime number? Did you report it as stolen to the network provider within 12 hours?
Both are clearly required to make a claim under the theft clause, so that could be your first hurdle. No free lunch, and no free laptop

There's no evidence of theft though
You can report it as lost to the police, but only if lost in public.
We all know that someone has stolen it, but playing devils advocate, have you checked with the local police that it hasn't been handed in?0 -
This exclusion made me laugh
Loss where the circumstance of the loss cannot be clearly identified i.e. where You are unable to confirm the time and place of loss.

It looks to me as if you should be covered assuming you reported it to the network and police within the specified timescales.0

My daughter went out for a ride on a bike last week fell in the canal lost her phone, went into the shop where she bought it from only to find out her £10pm insurance doesn't cover her phone if it gets stolen or lost.
She is getting a new one on the insurance though.0
