Write and request that they send the correct details. What else can you do?boylesarah wrote: »

1) Send them back recorded delivery
2) Probably
Not sure what you're looking to gain here?0 -
Not actually looking to gain anything...... was just looking for some advice as to the best way to go about this and if anyone else had the same experience.
I have drafted a letter and asked them to arrange collection as i don't see why i should be out of pocket when I have already paid for the info.
Thanks for the replies.0 -
You don't have to have the records collected, simply put them through a shredder if you can't afford the postage.boylesarah wrote: »I have drafted a letter and asked them to arrange collection as i don't see why i should be out of pocket when I have already paid for the info.0 -
Yes they could shred them, but how would Capital One be sure that the recipient had done so?
I for one would be very concerned if I'd received someone else's information. It would imply that they're not taking security of information seriously and indicates that several principles of the DPA have been breached. As a customer of that organisation, if they're sending information about somebody else to me, what's to say that they've not done it to someone else? Potentially someone has very valuable information about me, and a less than honest person could do some serious damage to my credit record.
I'd be asking what happened to my own SAR, has the other person received my information? If so what will the bank do to rectify this?
Luckily for the person on the SAR the original poster appears to be honest and appears to be genuinely trying to rectify the situation.Competition wins:

I think the only thing the Bank can do to "rectify" is to send the correct information. It's possible the contents of two envelopes have been incorrectly addressed, but I doubt the Bank will be admitting to this unless someone else complains that they've received the OP's information also in error.I'd be asking what happened to my own SAR, has the other person received my information? It may be as simple as this, but the bank have a responsibility to ensure the security of a customers' data.
As a Data Controller if I'd had notification one of the company's customers had received information in this way I'd at the least be investigating what went wrong and doing my utmost to reassure the customer that what went wrong will be fixed, and that meaures were in place to stop it happening again.
If it's a one-off then fair enough and probably just a talking to for the employee concerned along with making sure the correct information was supplied.Competition wins:

No doubt the OP will receive an apologetic letter detailing that exactly the above steps have been taken and providing the correct information. As a Data Controller if I'd had notification one of the company's customers had received information in this way I'd at the least be investigating what went wrong and doing my utmost to reassure the customer that what went wrong will be fixed, and that meaures were in place to stop it happening again.
Do you think the OP should be pressing for something different?
Mistakes do happen, I've seen similar instances reported on the forum in the past.0 -
Finally someone has understood my post!
The information I received was ALL of the information Capital One has on the person - i for one wouldn't want my information given out like this as in the wrong hands it could do a lot of damage to someone's finances.
I didn't want to shred the information as how would Capital One then know what they had sent me? I want them to understand that they have sent me the wrong details and to let the other person know that they have breached the DPA in relation to their details.
As i said before I am not looking to gain anything from this - just wanted to check if anyone else has had this happen and what the best course of action was - i am not a compensation chaser!0 -
You seem to have the matter well in hand already. You have drafted a letter with a demand that they pay for collection of the mis-directed SAR details. Now you can wait for them to respond with an apology and your correct details.boylesarah wrote: »I didn't want to shred the information as how would Capital One then know what they had sent me?
