fighting a pcn help

Hi I have been i issued a Met pcn, from outstaying my welcome at a popular fast mc food restaurant:( I initially paid but within a day felt annoyed that as I was valid customer that had been in the restaurant at the time, I wasn,t impressed so researched into this sort of issue a bit more, if there were signs outside I never noticed any, as i'd of gone elsewhere if they are placed like one in my local restaurant it is a small white sign high up near trees! I found this site and decided to send the challenge letter and stop the payment. I contacted mc no customer services who basically were not interested, saying they put met parking in place to stop prolonged stays. I called a manager at the restaurant who infact remembered me and said they would help. I am now expecting some response from Met and am expecting a fight. I feel that this is entrapment, there were tablets, play areas all to encourage you to stay longer and I didn't see any signage inside to warn, and I I am now looking for advice of next moves please.

    If this is England or Wales you have a chance by going to popla the independent appeals, so tell MET that you paid under duress and you now wish to appeal, inform them that if they don't refund your money as you were customer of the establishment you want a popla verification code to appeal.

    If its elsewhere you would probably need to issue against them unless McDonald's does actually get you a refund

    How long was your overstay? Was it a free car park?

    It was a uk carpark, and i cancelled the cheques. I overstayed the 90 mins by 30 mins, it was a free car park.

    Ah you stopped payment sorry not paying attention. Did you inform MET of that as they could issue against you for the cheque as they would incur a charge for it, plus the scam amount they asked for.

    Still ask for a popla code though, you still don't say this is in England or Wales , obviously it's somewhere in the uk

  • It was london, I did tell them via letter that I will challenge the charge as per the letter found in the section on this site and stated that the payment originally sent will be cancelled.

    That's ok then, just wait for a reply on your challenge, make sure to ask for a popla verification code if they reject, which is almost guaranteed

    If you are going the popla route you will need help to dismantle the whole basis of their scam and the contract they claim you have agreed too.
