    they wouldn't need to give any proof, they're not sending a fake solicitors letter... just giving the buyer the impression that they've taken legal advice.

    Which they have, this being a discussion on a legal matter, and advice having been given. 'Legal advice' is just that.

    I would agree with what was said above - always best to stick to the truth in these situations. Why muddy an otherwise solid case?
    If someone is nice to you but rude to the waiter, they are not a nice person.

    He could have cranked up a few thousand miles in that time, hopefully you sold with an odometer reading on the receipt, or on the sold slip you returned to DVLA.

    If he is getting a bit "scary" does your husbands business have a free legal helpline on his insurance policy? Or look at your home insurance, a lot of them throw in a Legal helpline for free.

    Re, the odometer reading - if the buyer is a well dodgy geezer - yes it is possible for an auto electrician to change the reading on the dashboard, however often the true mileage is stored in smart keys, and on the ECU. ;)

    Regarding texts and phone calls - you can set most modern phones to automatically block unwanted numbers. You won't even know he's tried to text or ring.

    Distance selling Regs ? who does this chap think he is.

    Distance selling regs only relate to a product that is bought either by post or over the internet and that the consumer couldn't inspect the item before purchase.

    So this muppet saw the advertised van on said internet, came and viewed it - bought it and accepted its condition and drove off a happy chappie. DSR my posterior ! he's good at making himself look a prize prat :rotfl:

    Sold as seen! And 2months is quite a long time. Consumer Credit Act means nothing in this situation. He inspected the vehicle before purchasing it.

    Tell him where to go and any further correspondence with result in "£40" administration fee per letter ;)

    Whatever you do, please please don't give in

    thanks to all who replied.. Have sent letter by recorded delivery wednesday so he should have had it by now.. I guess we will get another letter but we will not give in voluntarily!

    Nearly every ebay sale ends like this these days. These transactions were all around the same time, yet different buyers in different parts of the country:

    1. Sold a guitar on ebay. Buyer came back two weeks later, stating that the wiring had gone faulty and it had cost £120 for a rewire. Given I maintain my own instruments, I know full well a rewire does not cost £120! Asked for a receipt, a description of the fault or, at the very least, an explanation as to why he didn't contact me first. Mainly as I live close to the buyer, I would have happily taken care of any fault FOC. His responses were weak, fairly abrupt and full of holes. He couldn't even tell me which repairer he used - we live in a small town and I personally know all four of the possible repairers he could have used. Despite his utter b-lox, ebay sided with him and refunded him the cost of the guitar! Lost: £420.00

    2. Sold a games console. Buyer responded claiming the screen was cracked. I asked for photo evidence so I could raise an insurance claim via my shipper (I always ship insured). I knew it was b-lox as the console was triple-boxed with plenty bubble wrap. No photos, in fact, no replies. I raised the insurance claim anyway and the buyer finally responded when the shipper wanted to pick the packaging and item up. Shipper turned up to the guy's house three times to either no answer, or a torrent of abuse from some woman living there. The shipper cancelled the claim, yet ebay refunded the buyer eventually despite zero evidence at all! Lost: £93.00

    3. Sold a guitar case on ebay. Buyer came back saying that the handle had been smashed during shipping. Demanded he returned the case and I would refund him immediately. After two weeks, buyer just stopped responding. Luckily ebay closed the dispute with no favour.

    4. Sold another guitar on ebay. Buyer claimed it hadn't shown up and the tracking number I gave him was "fraudulent". Chased my shipper who confirmed delivery and even had a signature. After four weeks, buyer still claimed it hadn't shown up. He claimed that he lived in a flat with a communal entrance and that the shipper must have given it to someone else. Ebay sided with the buyer, yet mysteriously my account details didn't seem to work anymore so they couldn't take my cash away. Shipping investigator came back saying that the delivery address was a private residence, no communal entrance at all. Forwarded to ebay, took several weeks and another attempt of the same buyer trying to skam someone else before they eventually changed their minds. Potentially could have lost £800.00

    5. Had a car for sale on ebay. After the umpteenth message demanding I sold it for less than people were even bidding on it for, I pulled the advert. Sold it on gumtree, happy days.

    6. Sold some computer parts listed as "Cannot test, worked last time they were used so sold as seen". As it happens, I knew they worked perfectly, just didn't have reciprocal hardware to prove it. Of course, the buyer claimed they didn't work. I demanded he returned it all for a refund. He gave me a Royal Mail tracking number which never worked and was even totally the wrong format. Claimed they must have been lost on the way back to me, yet the tracking number being totally made up! Ebay sided with the buyer. Lost £112.50

    Caveat Emptor: Don't use ebay. They immediately side with the buyer with even the weakest of evidence. They do not want casual sellers on there anymore, they just want store fronts! If you have stuff to get rid of, put it on gumtree or go down to your local scrappy and get tonnage price for it or just dump it; it's less effort than dealing with the scumbags on ebay!
