Depends on what the offence is, if it's speeding or red light then somewhere like pepipoo.com is going to get you better advice.0

Details are as follows.
Back in December, there was an incident where a friend drove a relative's car and a speeding ticket was incurred.
My relative wasn't the driver or in the car but it was her car so she got the NIP in the post.
She quickly replied she was not the driver and named the person (my friend) she believed was the driver at the time.
My friend sometimes stays at the relative’s address but not always.
Anyway, a few notices were then sent to my relative in the name of my friend which my friend (the driver at the time) apparently did not respond to.
A Court Summons FPN has now arrived at my relative's address in my friend's name.
My friend insists he was not guilty of the speeding offence and suggested that something may have been wrong with the camera that awarded the ticket. Also, the court summons has misspelt his name and he's wandering how best to plead/address the matter.
The summons was received on 16th of May with apparently 7 days given just to defend it or plead Not Guilty.
NOW:
There's only one offence on the summons which is Failing to Provide Driver Details. Also the poor sod already HAS 6points on his licence from early last year for driving uninsured (I know this looks bad but he's not a bad boy, it was a silly mistake when he got caught. He's usually insured as he has about 7 years provable no-claims bonus).0 -
If your friend ignored the NIP then they are guilty under Section 172.
All they ask at this stage is who the driver was, not whether they admit to the offence. You do that after fessing up to being the driver at the time.
Sorry to be the bearer of bad news here, but your friend has committed an offence regardless of whether or not they were speeding.0 -

You seem to be aware that "a few notices" were received at your relative's address in the name of your friend, so why didn't your friend respond to those?
Why did it take a court summons on the doormat for your friend to remove his head from the sand?
I would suggest you visit Pepipoo as advised by Lum as they have members who are more specialised in these issues. I'm afraid it doesn't look good for your friend if they already have 6 points on their licence.0 -

The general opinion seems to be that a simple speeding offence that may well have been dealt with by going a "speed awareness" course could well turn into 6 points for failing to furnish and a 6 month totting ban.
I know this is a direct result of the OP sicking his head int he sand (as he has amitted) but you've got to feel that a 6 months ban is a bit harsh, especially when we all see dangerous driving go unpunished almost every day. 0 -

The OP's friend actually displays a typical disrespect for the processes of the Law of the Land.
Which we all want to see enforced, yet complain when it is flouted, and punishment issued?
If we want to see more 'dangerous driving' reported and dealt with, why not pay a lot more in tax, to finance a lot more Officers on the streets, enforcing the Law?
Of course, that would be grossly inconvenient for far too many folk?
Or, go for more enforcement technology, to free-up Officers to enforce other offences?
The alternative is to observe, take notes, present Statements, to the Authorities about events?

I take issue with this comment. We came here to see what help we could get in this unpleasant situation. Judging posters attitudes to things like "the law" when you know very little about the fuller context of their lives and their conduct in other important areas is a massive call to make. The bottom line is that
1. People aren't perfect and
2. The world is most certainly not perfect. Even our laws aren't perfect.
Things happen. People come here to get help and advice so they can help themselves. If we were family moneybags, this would already be in the hands of a specialist solicitor!0 -

We already have driving without insurance, then speeding and now ignoring the ticket.
Might be more than 6 months!0
