I think it depends on on the adjudicator to be honest. We have seen it go both ways and also the same in court.

I would always spell out what are the costs of running a business such as wages, uniforms, signs etc and establish that point on the grounds that they would still be there if my car had been elsewhere.

I would say that the DVLA cost, a small amount for stationery and postage are the true losses. Judge McIlwaine said as much in the ibbotson case. Check it out.
