Well in that case here in Oxford the council tax officers are helping to commit that fraud.
A couple of years ago I enquired about an exemption on an empty property and as it was going to remain part furnished they told me it couldn't be exempt but they gave me a single persons discount, at their suggestion, not my request.
- you can only have one SPD in place at any one time.
- you cannot live in another property where you are liable for CT (even if paying full CT at the other property because there are 2 of you at it) and claim SPD on the place you do not live in, whether that other place is empty or not
you'll notice that CIS did not correct my post because what I said is correct, claiming SPD on an empty property is fraud if you are liable elsewhere0 -
I can assure you I am not wrong as that was exactly what happened.
However your explanation does throw some more light on the matter. It was actually me moving out of the property to go to the US for a year, and I am assuming that as there was still furniture left at the property it couldn't be classed as unoccupied, so no fraud was commited and the Council tax geezer did know what he was doing.0 -

It would seems you only had a temporary absence with an intention to return therefore you were regarded as still being resident in the property and any normal single occupancy discounts would apply.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0
