Rejecting a used car- section 75?

7th June is an unrealistic date for any remedy.
Section 75 claims can take months to resolve. There is a lot of work involved between card issuer and seller. Documents have to be looked at, correspondence will go backwards and forwards between the card issuer and the seller, this all takes time. Your card issuer won't be able to give you any definite timescale, it's a bit of a waiting game really. Prepare yourself.

Lets be clear about one thing here, you bought an 8 year old car, and should expect a level of wear. You could take any car in to a garage and i'm betting you if they looked hard enough and was picky enough they could find a great deal of issues.
You've listed a lot of problems, many of which can be immediately discounted as wear and tear.... brake discs and pads for example are consumables.
The clutch and gear linkage - showing signs of wear or have they gone kaput?
The coil pack may actually be the cause of the cut out, it's not unknown.
From what i've read of your post (and it's certainly a long one), the bit that would create an issue perhaps is the head gasket - is this actually on its way out and the cause of overheating? I would have said if the water pump was nackered this was the cause tbh.
As for section 75, they are equally and severally liable - but they could choose to offer a repair rather than refund which is permitted.0 -
I know to expect a level of wear and tear, that is normal, what I don't expect is to have all these issues within less than 2 months and 1000 miles of ownership!
I am still awaiting the report as the service administrator is off sick but the service manager has said that clutch and gearbox will require 'imminent' replacement. In their opinion it also shows signs that it was in a front end smash as the panels aren't right? I was certainly not told of this and I wouldn't have purchased a car that had been in an accident.
I asked the question that I really wanted to know the answer to, which was, 'were these defects there at the point of purchase, in their opinion? and he said he was quite sure they would've been. I've asked can they state that in the report and he has said yes, they will report their opinion on that.
Head Gasket, I asked was this as a result of the water pump failure. They did that that work, so they would know what they did and what they checked. They asked me to describe the breakdown, which was I was driving outside their showroom on the dual carriageway, the car temp shot up and the 'stop' light came on. I stopped and called the RAC as I didn't fancy chancing it on a dual carriageway, the RAC diagnosed the broken water pump and it went to Peugeot for repair.
They tested after that repair and the car didn't overheat and hasn't since then until now. They said they would not ordinarily check the head gasket unless the repair failed the resolve the issue or the customer asked. I don't know where In stand on that one.
The rear axle has a 'recent' repair, which has failed but I don't know those details and the bloke didn't seem to know much about it but said it was the Master Technician who was dealing with it, he had just notes.
I'm not really much wiser and I'm still car-less! I am getting a courtesy car tomorrow for the day, so not all bad. The are photographing the car and finishing up on what they are doing but I've decided I'm going to buy a new car this week, I can't work without a car, but I will be buying from a main dealer!
I'll be shoving this car in the garage and taking a chance on a successful S.75, if it is unsuccessful, I'll put it on eBay as spare/repairs.£2 Coin Savers Club (Christmas)- £86£1 Jar (Christmas)- £29Christmas Vouchers Saved: £1450 -

It's 78k, so pretty normal if you assume 10,000 a year, I was offered £1500 against a new Peugeot today if I traded it in on a new 208, but I don't want a 208.
I can't see it would be worth much more than that part ex, privately, it *might* be worth £1700-£1800 but it's only worth what someone is willing to pay at the end of the day and that's assuming I did the works, it would never give me a return. I only planned on keeping it for 2 years anyway, so I wouldn't get a return in 2 years if I kept it and did the work.
I bought it because I thought I wanted something smaller and cheaper but it was a huge mistake, my 307 had given me no trouble, it just drank petrol! This one is actually excellent on fuel and inside it is immaculate and outside visually, it looks fantastic but sadly not what the eye can't see.
I will chance the S.75, nothing to lose, will buy new car on credit card then pay straight off (from my savings and current account) so I can get the same protection should I need it.£2 Coin Savers Club (Christmas)- £86£1 Jar (Christmas)- £29Christmas Vouchers Saved: £1450 -
