    Plus the collections dept is in Birmingham not Chatham.

    They don't really tell you where they send letters from. Even straightforward letters don't necessarily originate from the address at the top.

    But I don't believe they have a "Customer Refunds Team".

    They do actually.

    Waterside is actually a CSC and have nothing to do with debt collection.

    Cricky waterside deal with cheque payments and various other things but they are not linked to debt collection as the debt collection centre is in brindly place Birmingham.

    I would just put the letter to one side for 3-6 months then contact them.

    Statute barred does not mean you can ignore your debts for x amount of years and then they are written off.

    Statute barred means that if a bank does not make any attempt to collect the money from you in x amount of years they lose their claim on the debt,

    The reason this exists is because it would be deemed unfair if a bank made an error, did not request a payment due and then noticed the error later on and tried to get you to pay. It would be unfair because you would reasonably believe that there was no debt. The onus is on the bank to ensure that they make an effort to contact you to inform you the debt exists.

    If you ignore the letters, phone calls etc. or fail to inform them that you have changed address then that does not write off the debt. The bank merely have to prove that they sent letters to the address they have for you, and also tried to contact you.

    This letter, even if you ignore it, may keep the debt alive.

    That said, often because banks do not like 'bad debt' on their books they will get rid of it by either writing it off, or selling it on to someone else. Once that occurs the bank are not really interested any more. They have basically given up on it.

    No idea what the letter is. I once worked for an insurance company and we would often have money owed to people we could not get hold of. It just sat there. In some cases people would complain that they were getting contacted, even if the reason was for them to be informed they had thousands of pounds waiting for them. They would threaten to contact regulators if the letters did not stop. Unfortunately we were not able to confirm any amounts owed until they could prove their ID, and a lot were not willing to do so as they did not trust us. So they ended up losing out.

    I believe that the law has slightly changed and the money (if not claimed) goes to the government. Into some sort of 'Big Society Bank'

    So if you do not wish to contact them then at least you know that any money they owe you (if it exists) will not go to profits, but instead to good causes (of sorts).

    Surely if by that point the debt is statute barred, so too will the money they supposedly owe him?

    And statute barred just means they can't pursue him in court. They can still pork his credit rating (well, pork it MORE) and such.

    In all I think it's fairly cheeky to borrow money, not pay it back but then expect them to pay out money. More fool them for offering to I suppose.
