In my view you were right not to stay if you were seeking a refund of the holiday. It's much harder to justify a refund after the event if someone stays, and especially if they don't complain at the time.
If it's the hotel that others have mentioned, the wording when booked directly with Merlin seems descriptive enough for a customer to decide whether that's the sort of accommodation they'd require.
I personally suspect that a judge would be quite likely to accept a claim that asked for a refund (which you've been offered I think) but to ask the holiday company for a full refund and a entirely new holiday elsewhere is probably pushing it.
I can't see that there's any specific legal definition of a hotel, it seems that this does meet such a requirement as it provides accommodation. It would be for a court to decide whether your contract misled you and whether the company made misrepresentations about the accommodation.0 -

What exactly were all your additional costs?
Instead of ****'ing everything out, couldnt you just have said hotel A, hotel B, from hotel B to park blah blah?
Not trying to offend, just it would be easier to read and understand if it was set out in the above format compared to its current and I was trying to work out what all the shuttle expenses are.You keep using that word. If it is the Thorpe Park Crash Pad, it is classed as a snoozebox hotel, its there temp while they finish drawing up plans for the permanent hotel they are planning to build on that site... these snoozeboxes are used all over the world at the moment. 4 of my friends stayed at the Thorpe Park one a few weeks ago,a group of middle age ladies and loved it but its all down to taste and expectations. They knew they were going to be sleeping in containers, surely op you must of realised they were shipping crates before you booked? You don't mention asking for an alternative room, did you ask to see another? I would take the offered refund and put it down to experience and next time do more research.
I had no idea I would be staying in a shipping container! There were no other rooms to look at, they were at full capacity. And the receptionist told us you can hear the toilets flushing and people talking in all of the rooms.0 -

Really ? I could have got a travelodge for £19 per night and would have been in an actual hotel rather than a freezing cold container. Minuis the cost of what the tickets should be would still make this 'hotel' just under £80 per night, that is not cheap.
Im not sure what is unreasonable about wanting to be warm enough to be able to take off your shoes and coat, for my partner to be able to fit in the bed, not wanting to hear other people going to the toilet - not only can you hear them flush but you can hear what the person is doing on the toilet :eek:0 -

To represent it as 4 star I feel is misleading though especially when they say the place I did stay in is only 3 and quite honestly its the most luxurious place I have ever stayed.0 -

How could your partner not fit in the bed? There are reports on TA of groups of three and four staying in the rooms, I can't see why two would have a problem?0 -

Sorry, I hadn't thought of doing that.
Basically the shuttle expenses were to and from the attraction, I had it all booked and paid for and it had to be cancelled and new ones ordered and repaid for.0 -

How could your partner not fit in the bed? There are reports on TA of groups of three and four staying in the rooms, I can't see why two would have a problem?
Length wise not as in he is very wide - we have a standard double bed which he fits in with room to spare, with this he had to go at an angle otherwise he had to bend his knees to fit.
We were told the heating problem could not be fixed, the receptionist told us its a problem in all of them because they are portable heaters.0
