Parking eye

Hi , I parked in a car park who uses parking eye. I did my shopping and was in my two hours parking time so rather then move my car of the car park, i fed my newborn baby which took my car park stay over the two hours.
I received a parking notice which I ignored, received another 3 weeks later saying if I didn't pay £60 then I would have to pay £100. The daft thing is when the second letter arrived the date to pay the £60 had expired.
I have received a new letter today saying 'if this letter is ignored, further action may be taken such as the instruction of solicitors to secure immediate payment or the issuing of court proceedings which could incur further costs. To avoid further unnecessary costs r actions, please pay the outstanding parking charge amount as stated above in accordance with the parking terms and conditions.

What do I do ??

Firstly - please don't pay them until you are fully aware of all the options. This is a scam, and if you follow the advice on here you are unlikely to have to pay them anything. One of the regulars will post soon with good advice, but please don't take their threats too seriously. These people have no real authority, they can't fine you, just get a CCJ by sending letters or send the bailiefs round despite what their threatening letters say.

"'if this letter is ignored, further action may be taken such as the instruction of solicitors to secure immediate payment or the issuing of court proceedings which could incur further costs".

The key word here is "may", rather than "will". Think about it this way - "You will win £20m on the lottery", "You may win £20m on the lottery". There's quite a big difference in meaning there.

And if they do actually issue court proceedings there are people who will be more than happy to advise you in how to defend against them.

As parking eye know who you are as you have given to much information, I suggest you appeal this if in England or Wales , if they refuse you go to the independent appeals popla. We can help you do that.

So what dates and how many letters in the post are we talking about, and are the letters being sent to you (the driver, if you are also the registered keeper) or is the registered keeper someone else?

You may be technically 'too late ' to appeal to PE as such but in fact you can still get this sorted and you should have complained in the first place.

This is a breach of the Equality Act; nursing mothers CANNOT legally be harassed for the time taken or place chosen to feed a baby. You're covered by the Act, if breastfeeding - like here, read this thread from start to finish:

    http://forums.pepipoo.com/index.php?showtopic=74849

    and this summarises the law:

    http://www.babyfeedinglawgroup.org.uk/thelaw/feedinginpublic

Whose car park is it, a Supermarket or Retail Park? You'll be wanting to send a major Equality Act breach letter of complaint to them asap to get this harassment stopped. If they don't, you can sue them for money in compensation, you know! Copy the PPC into the complaint too, be VERY assertive and include links to the law.

The ticket is from the beginning of April so should be in time to send an appeal into them coupon

Not sure that it is - the first letter would have been a postal NTK ages ago in April, then the OP says there's been another letter since.

No I've seen when the ticket was given as it was posted up, so the letter would have been within a fortnight of that which is mid April, so there may still be time. It depends what the second letters says I guess. But as the post was up for over an hour before edited I think it's been clocked by PE employee.

Do they still offer popla in their letter at all ? If not you only have 2 choices pay them or ignore them short of a small claim. There is something though are you the registered keeper as well as driver? If not the RK can still name you as the driver ?

    So? Why the long face?

See my reply above, in post #5 - they have broken the law. You just need to tell them and the car park owner/occupier in a written complaint. EASY.

(Do people glaze over that much when I post about Equality Act breaches? Even when I've said they've broken the law and you can sue them if they pursue it once you've told them you were feeding a baby & pointed out the law? This one is soooo easily dealt with and should have been a complaint at the outset)!!
