From the OPs message it seemed the company were at least responding. I wasn't sure how much the problems were down to a language issue, nor was it clear whether the OP had stated what they wanted to happen.

It could be that the company think they're offering excellent email based technical support.

If the OP has been clear that they want a remedy (rather than just assistance) then I'd agree, letter before action.

    Why would you avoid it?
I would send them the letter by recorded delivery giving them 14 days to reply, then Letter Before Action, then money claim on-line adding 10% for expences, costs etc. If someone wants to sell to then general public they should not be allowed to con them.

Please stop plucking random figures from the air, its getting tedious now. This is not a consumer wants board, its a consumer rights board.

And unless they have actually suffered 10% of the cost as expenses reasonably incurred due to the other party breaching the contract, they have no right to it.

You know this as its been explained to you probably over a dozen times. Yet you choose to ignore it and offer not only incorrect information, but information which could put them in a less than favourable position should they actually go to court over it.

They've finally agreed to have a look at the fault. I told them they are under obligation under The Sales of Goods 1979 to repair/replace/refund and if they don't oblige then I told them I will get trading standards involved. Thankfully this seemed to do the trick so thanks for the advice.

I don't trust them at all however so I decided to take a video recording showing the fault, then showing me packaging the item up and taking it to the post office. I received confirmation from them yesterday that they had received the item and will look at the fault soon. I wasn't happy with this because it had already taken over a week for them to acknowledge that they need to either repair/replace/ or issue a refund so to me "soon" could mean absolutely anything. I sent them a message saying this but have heard nothing back thus far. After all this is done I'm going to shout from the rooftops about the appalling service they have provide so others don't have to experience what I have. In the mean time though, if I continue to have problems with them how would I go about taking them small claims court? Would I have to pay anything, and if so would I get it back if I won the case?

Probably best to stick to a high street retailer in the future. You may pay a bit more but it can be worth it.

Why not start by reading MSE's Small Claims Court guide?

P.s. I hope you can read my small writing. ;)

Have to disagree with you there. If it was a couple of pound cheeper then sure, but I saved £200 by doing a bit of research and buying online. I bought from a seller that was listed as a "trusted supplier" on two reputable forums so thought it would be fine. I've reported my experience to both forums who have removed them from their trusted suppliers list so at least other people won't have the same problems I'm having.
