    No you shouldn't. Miss declaring gifts now carries significant penalties. In a number of international markets gift descriptions are no longer allowed.

    Can you answer the question on what you declared them as please?

    The problem you will have is to be reassessed for fees is likely to require the payment of a fee. Which could be, collectively higher than The duties and taxes you have currently been charged for.

    How can they prove it is not a gift of clothing?

    I'm betting it wasn't declared as gift, but the OP is still going to try not to pay anyway.

    If you didn't declare it as gift you made a mistake. Accept it, pay and remember for next time.

    I didn't declare it as a gift as it wasn't a gift. 2nd hand knickers and tee shirts... Not much of a gift!
    My daughter doesn't have 60 dollars otherwise she would have bought the stuff there. Guadalajara is a very expensive city.

    When they inspect it. Trust me these countries are notorious for excessive fees, India is one of the worst for it.
