Sorry, my post clashed with yours so missed the bit about you renting a property owned by your parents...
If you are paying them rent, make sure the mortgage company (if there is one) know! Might not be permitted.

We are now just thinking about what sort of negotiation we should offer at four and a half months, im thinking something like three months rent as a lump sum to just end everything when we leave rather than relying on someone moving in fast?

I think if you leave it now, they'll just be stricter at that time and try to force you into thinking it's easier/cheaper to stay for the 12 months. You need to get the letting agent to admit their mistake and sort out now what the deal is at the end of the tenancy. I'd let them come to you with a first proposal.

I would start discussing with the LL informally ( ie not formal notice) earlier.
And get whatever is agreed as the conditions for Early Surrender confirmed in writing.
If you cooperate with viewings by prospective tenants and the LL has plenty of notice, he should be able to get a replacement tenant lined up, minimising the gap between you and next tenant (void).
A fair agreement would be for you to pay
* marketing costs to find tenant (and/or LL's agency fees)
* rent during 'void' period0 -
6 weeks might not be that bad time period specially if you are in and around london where a flat once its on market could be snapped in hours. Your situation could be different though.0
