The Solicitors letter says we must be out by 1st Dec but my BF just wants to get out (not keen on paying another months rent) so he advised our LA of our intention to leave sooner via email and a follow up phone call.

Today we've received a letter from the LA confirming that the Check Out inventory is booked for Nov 1st.

EDIT: We were hoping to have a days grace to move our stuff out as it's a Saturday but as it's the date of the Direct Debit for the rent, they've quite rightly said that our last day is the 1st.

Well, we've been served a Section 21 notice

An unsurprisingly common occurrence for those that listen to a thread full of confrontational, anti-landlord, barrack-room-lawyers on MSE.

    :money:

The non-confrontational route is always the best route.

Sending p1ssy letters to HMRC is a sure way to get evicted.

I don't think my letter was !!!!y. If we had received the letters during the first few months, I would've forwarded them on as asked. But considering they turned up around 18 months after we moved in, I thought it would be better to inform a Government agency that those people weren't living here and that we didn't have a concrete contact address for them (bearing in mind that when we moved in, we were told that they lived abroad AND that the original forwarding address was changed).
In addition, if they have written to us from another country, we would have been inclined to believe them but it seems an awfully long way to come to deliver a hand written note asking us to forward their post nearly 2 years down the line. It doesn't add up.

Anyway, they can do what they like, it's done now. If I had to choose between a Government agency and risk damage to my personal info and some people who take offense at the smallest thing; I'd pick the HMRC.

You've missed the point slightly, though in the end it may not matter.

If you stay until the 2nd, then you start a new rental period and you are liable for rent for the whole month. In fact, if you stay beyond the expiry of your notice period, then I think you can technically be liable for double rent.

It's not just a question of having another day because it's convenient. The dates when you pay the rent are not necessarily determinative - as I previously asked, what were the start and end dates of your previous fixed term tenancy?

Sounds like leaving, by however means, is the best option for the OP anyway as the LLs are at best clueless muppets and at worst fraudulent crooks. I'd have been long gone by now, sending p!ssy letters to just about everyone in the process. Some tenants have both the money and the inclination to make an example of LLs who treat them with contempt - not all kowtow to such bullies.
Remember Occam's Razor - the simplest explanation is usually the right one. :)

    **UPDATE**

We moved out last Saturday, thanks to our new LL letting us move in a week before the tenancy actually starts (today). We had our check out at the old house yesterday and the guy was very complimentary about how clean and tidy we'd left it and that he had enjoyed doing his check ups during the last 2 years - in and out in 60 seconds he said!

Had a missed call from the old LA last night and when we called back this morning, he told us that the LL had complained about a stain we'd left in the microwave (cleaned inside and out, just like everything else). They must have been on the next flight out of "Portugal" for them to have been in to poke around that quickly - we only left it yesterday at 12:30 and the missed call was at 5:45! Anyway. the check out guy didn't mention anything to us about it and the stain was in fact RUST, which I (and the old LA) would consider to be due to normal wear and tear and the age of the thing.
The LL has been round to the LA office this morning to pick up the keys so that just confirms to us that they've been in the UK the whole time. Surely they would have picked up the keys first, then mentioned the microwave later today after inspecting their house? Makes my skin crawl knowing that they've been hanging about for the last 2 years.

Anyway, the whole thing stinks from start to finish and I'll be glad when our deposit comes back (the old LA said he'd get it signed off today). Fingers crossed it'll be for the whole amount.
Loving our new home by the way!!!
