    dear me - another new member comes for advice and gets blasted

    i mean come on - just because someone has S&D and gastro in one month does not mean they are dirty!

    and i have never had oral thrush - but i can imagine it being extremely painful and i certainly would not want to be at work, trying to sell things over the phone

    the OP has had a lot of absences - but not lengthy ones. is it not possible they have had a bad year - and could have gone for another 10 years without another sick day off work?

    hope you find something else soon OP :(

    The problem is the OP may just have been unlucky but also on the other side what if this issue of time of carried on for the next year?

    At some point the employer has to cut their losses and move on.

    P.s if you had read the thread you would see the OP already has another job which is good news

    yes congrats on the job. that explains half your bugs. the kids. its good that you don't have it.

    now has your past employer paid you your correct wages including holidays ect.

    Does your workplace have a managing staff sickness policy? Has your employer followed the policy? Have you exhausted all your rights under the policy (assuming it exists) for appeal? Did your union represent you at any hearings under this policy?

    Almost all managing sickness policies have stages (you refer to this yourself). It is likely that after four instances of absence you will have had a "first meeting" or similar, maybe as part of a "return to work" interview, and been set targets. Two absences in the same month of flou fllowed by laryngitis may then have triggered action.

    The issue of a doctor's note is irrelevant, you are likely being dismissed because of numbers/duration of absence, not falsification of sickness record ( a disciplinary offence).

    EVERYTHING I have said here should be known by youir union rep, who should have been advising you all along.

    After being employed for four years you have employment rights, so if the company have not followed their own procedures you should have a good claim for unfair dismissal. There are lots of gaps in your account of how you got here, so can you try to answer the questions I have posed please.

    Congratulations on your new job, this might mean it is not worth pursuing any claim for unfair dismissal because your loss will be minimal (although that depends on whether there is any loss of wages due to period between jobs).

    Hi harrysdad :)

    Yes they do have an absence management process, which annoys me after reading that they could of not got rid of me and gave me no sick pay for the next 12 months, which is completely fine, but just to get rid of me like that is heart breaking. There was other avenues they could of taken in which they never so obviously they wanted me out. One of my friends who worked there didn't realise that she was diabetic and took time out to go to the doctors and be tested for sugar and this went against her and they dismissed her as well!!! Like in our place if ur face doesn't fit your screwed!!! We have conferences every year there and we are under strict instructions to behave as your still representing the company and work rules apply, one of the girls smashed the hotel room up and that should of been gross misconduct but because she is the boss best friend she walked away Scott free!!! Company is a joke!!! They didn't have to chuck me out, I could of done so well there!! Oh well there loss!!!

    I don't start my new job until June and I have my appeal meeting next week. I hope it doesn't go to a tribunal as I didn't want that, I just thought what they have done is wrong, but who knows what will happen!!!

    Thanks to everyone on here that has given me some lovely advice and I shall take it all on board!!!

    If that's 6 occurrences of absence, then that would be 810/(6x6) = 22.5 days.

    Your total of days off only seems to add up to 16.5 (assuming you had just 1 day off for laryngitis). Or did you have 6 working days off with laryngitis??

    I'd also argue that the laryngitis and flu were clearly linked.

    What happened at the back to work interviews? What did the medical health people say? Was it clearly explained to you that any more illness would result in dismissal?

    I did have to go to the medical health people who done an interview over the phone.

    Unfortunately my sickness levels have been about a week long, but what I'm trying to say is how can this system over rule a doctors note?
    Your doctor has a duty of care to you, not your employer. They act in your best interests. As you've discovered, when that isn't in your wmployer's best interests, they so something about it.

    I do have a union rep that's backing my case, but here goes :(

    Recent 19/04/2013 was off with laryingitis, doctors note was issued.
    9/04/13 - 12/04/13 - flu
    19/10/12 - 25/10/13 - had my tooth taken out and it gave me oral thrush - doctors note covered
    Left work at 11.00am 10/09/2012 only half a day due to sickness
    23/07/12 - 27/07/2012 - gastroenteritis - doctors note covered
    09/07/2012 - sickness and diarrhoea

    All I'm saying that all my illnesses have been genuine and I'm not having days here there and everywhere, if I'm ill I'm ill!!! I'm a full time mom to three children and in my family we do have ibs, so when I was off with gastric I was tested for this, luckily it came back ok!!! All I asked was for some advice which I have taken on board!!! Luckily I've got a new job today and start in June, so u can see already that I've haven't been sitting on my !!!! feeling sorry for my self!!!

    Your friend could have asked for the diabetes to have been not counted as it maybe a reasonable adjustment under the equality act.

    And I doubt they are worried about their loss, if they were they wouldn't have sacked you.

    You need to have a clear understanding of what you want from teh appeal procedure, talk to your union rep, make sure they are aware of the new job and work out what you want (ie see if you can get a compromise agreement with an agreed reference)

    Sorry I'm working off my phone, when I was off with laryingitis I was off for 6 days!!! I was taking everything that I could to get my self better but my throat was so sore I went to the doctors and they signed me off, if anyone has laryingitis you will know how sore it gets! I'm gonna speak to my union rep tonight and see what he is going to say!
