    In theory.

    Almost every document I've read talks about adjusting for disability/medical conditions which may result in more short term absences - but when I worked for an NHS trust, I was beaten about the head with my Bradford Score by an unsympathetic boss who refused to refer me to OH.

    Many employers will use a Bradford Score for dismissal/redundancy purposes but if the OP was in post for less than two years, then the colour of the sky on which she was hired, her star sign or her eye colour are just as relevant.

    Hi there,

    I did have to go to the medical health people who done an interview over the phone.

    Unfortunately my sickness levels have been about a week long, but what I'm trying to say is how can this system over rule a doctors note?

    I have been there 4 years and no have had no warnings about my absence at all, all I've had is my back to work interview and they tell me what stage I'm usually at!

    A doctor's note is only proof you were genuinely ill.

    You were off sick for different problems and you don't mention any disability or long term medical condition that any employer would have to take into consideration.

    A doctor's note does not provide any immunity from an employer's own sickness policy.

    It can as it's still an absence from work whether it be fit note or self cert, a doctors note only confirms you have a illness and a period of time they recommend you have off work to recover. It doesn't protect you from the bradford factor or from you being dismissed.

    it really was not the length of time but 6 episodes in a year is what did it. the wife is a nurse and they have to stagger in with all the aches and pains. they have a maximum of 4 days or 3 episodes before they are refered to OH. the wife had pneumonia last year and had 4 weeks off they placed her on capability process. it really stressed her out. so i know it horrible.

    however by the sound of it your employer was using this as a means to get shut of you. i take it you not in a union. the rcn helped the wife.

    i suppose if you can prove that the episodes were real and you had not abused the system then you may want to speak to an employment advisor. sorry to ask what was your sickness record prior to these 6 episodes.

    if any of these episodes were related to a long term illness the equalities act comes into play.

    Recent 19/04/2013 was off with laryingitis, doctors note was issued.
    9/04/13 - 12/04/13 - flu
    19/10/12 - 25/10/13 - had my tooth taken out and it gave me oral thrush - doctors note covered
    Left work at 11.00am 10/09/2012 only half a day due to sickness
    23/07/12 - 27/07/2012 - gastroenteritis - doctors note covered
    09/07/2012 - sickness and diarrhoea

    Sorry, the chances of you getting your job back are very low.

    Your absences are unrelated, so no apparent disability, which would give you some protection under the Equality Act.

    You say you did not have warnings but then you say at each BTW you were told what stage you were at - this is equivalent to a warning. If you know you are at stage 3 of a 4 stage process, with 4 being dismissal, you get yourself into work no matter what.

    A medical note does not get your absence discounted. No one has suggested you were not unwell, but rather that your absences due to ill health are far too high.

    you could argue that the flu and laryingitis were connected opportunistic bugs hit after flu. thou real flu knocks you out for more than 3 days.
    again the last 2 could be harder to argue but worth a try. the thrush a week off sorry that one really is the bad one.

    maybe your best bet is to try and negotiate a better reference. even if you proved you were terminated unfairly you would not feel safe if they gave you your job back.

    probably best in future to stagger in and get them to send you home.

    i really hope your union helps. good luck.
