If you have done nothing wrong then don't worry about it, I had an interview with a compliance officer as some little !!!! decided to anonymously report me for fraud , they get thousands of malicious reports like this every year and are quite used to it , I met a very nice lady for a 5 min chat in my local job centre office and that was that , all over and completely painless

As above if you have done no wrong then dont worry about it, just tell the truth. I had an interview although not my fault I still felt I was in for it.

I realise the burden of proof is on the council, but they have their "proof"; the declaration from the other party. What proof could you provide that the person doesn't live with you?

But it's not really proof. It's a statement of one position contradicted by a statement of another. Something independent would be needed and it would be easy to disprove - where's the post that was delivered to that address? Where are their belongings? Do they have a door key?

    * * *

On the other issue of not answering questions or not even going, it's all very well to say one has the right not to.

The right to silence is not supposed to imply guilt. But in the real world what will people think?

What does it look like if one doesn't co-operate with an investigation? And how will a real person react to that? At the very least it could affect how long an investigation goes on for and how they go about it.

We have rights but we don't have to use them "just because".

Nobody is required to attend, the OP could just tell them to !!!! off if she wanted to.

And they could just suspend her claim until she did attend. That's the usual course of action.

The mail that did come to my address from her employers (Local Authority) was never responded to as my daughter visits only once every couple of weeks and by this time its all outdated. Also she doesnt have a door key so if they have watched the comings and goings from my home (what a tedious job) they would see that she has to ring the doorbell to gain entry.

I am definately going to attend as yes it would look as though i had no defence and i certainly do.

I have asked my neighbour who moved in to the property in June 2011 to write a statement confirming that my daughter has not lived in my property all the time she has been my neighbour. Ive also asked my ex partner to write a statement confirming that she has not lived here for many years either. That's the only evidence I have .

and the daughters bank statements which go to boyfriends house. that is proof of address. and anything else official she has

Hi I was interviewed under caution by the benefits agency due to a mix up over some paid work I did.
I was terrified as you are, but honestly it really was not as bad as I thought it would be, they did record it which made me feel a bit like a criminal and though the interviewer was quite stern he was merely information gathering and was not accusatory in the slightest.
The worst bit was waiting for the decision to be made.
Good luck try not to panic, keep in mind as I did that you haven't done anything wrong, and make sure you make your points clearly, oh and take a paper and pen so you can note down any points you need clarifying or want to address at the end. X x

It helps, of course, that your daughter doesn't have a key, but it wouldn't matter if she did.

I have keys for my parents' house, and my OH has his brother's house keys, too. My parents have a set for our place, too.
...much enquiry having been made concerning a gentleman, who had quitted a company where Johnson was, and no information being obtained; at last Johnson observed, that 'he did not care to speak ill of any man behind his back, but he believed the gentleman was an attorney'.

Thanks. How long did you have to wait for a decision to be made? How long was your interview?

I had in mind a more general issue of alleging one lived in a particular address like in dktreesea's post. If it was true, one should be able to provide details of various agencies holding that address but, as well, if one really was living there one should be able to produce post mailed and delivered there that one could access.
It helps, of course, that your daughter doesn't have a key, but it wouldn't matter if she did.

I have keys for my parents' house, and my OH has his brother's house keys, too. My parents have a set for our place, too.

I think I still have a key to my mum's house and she's 3000 miles away. Maybe she changed the locks. :rotfl:

It's the reverse that's important though. Someone alleging an address is their home as referred to in dktreesea's post (as opposed to the OP's case) should be able to back that up and actually having a key would be fairly essential. :rotfl:
