Orange guarantee issue

Hi all, hope somebody can help me. I took out a mobile phone on contract from Orange some 8 months ago - 2 year contract and last month the phone just died on me. There is an issue with the phone that this does sometimes happen, and if there are instances of sudden deaths like I had, mobile phone companies will take the phone under guarantee and examine the phone before replacing the same if there is a fault.
When I rang Orange to tell them of my phone dying, I asked whether they could transfer my sim to another phone. I explained to them that the phone just died on me and I will need to buy a replacement. Can I ask, are Orange obliged by law to advise me that the phone is under warrenty as it is less than 12 months old - knowing the phone is under guarantee, I got rid of the phone. They have admitted that I told them the phone died suddenely on me but advise me they are not obliged to advise me of their statutory 12 month warrenty period. Really would appreciate help as the phone is a Galaxy S3 and worth some £300 to replace.

S3s generally have a 2 year warranty, rather than just a year. What did you do with the phone?0

Well I work in a very senstive job and there was some data there I could not trust for other people to read (data security). I saw scare stories on Watchdog re other people being able to rwad stuff on dead phones so I couldnt take a chance and sell it as dead on ebay so I broke it up and binned it.0

It's not a statutory 12 month warranty.
And that warranty is with the manufacturer, not Orange.
There is also your statutory rights, but how were they to know the phone was inherently faulty, or that the fault was covered under warranty.
I wouldn't rely on the retailer to advise you of your rights... They often struggle to meet them even if you know them well.0 -
Orange are not obliged by law to tell you anything about your rights regarding faulty goods, common sense tells you you have a minimum 12 months on all most everything you buy in the UK. It's your fault not theirs.0

Thanks for the reply, I appreciate what your saying but as phones who suddenely die as mine did are routinely taken by Orange and sent away for testing - and if necessary, replacing - are they obliged to inform me of their guarrantee given they were fully aware my phone had died (I told them that) and they routinely, in such a case, ask phones to be returned under guarantee?0

Why did you not ask/check for yourself if it was under warranty? You did not have to destroy it or sell it. If you had held on to it you would have got a remedy now you know Orange wquld have looked at it...but then you didn't want anyone to look at it so you destroyed it. I think your going to have to suck this one up yourself.0
