mis-sold phone4u jump contract

recently just found i have been mis-sold my jump contract with phones4u. has anybody else had this issue?

this was my post to the phones4u forum.

Last year i purchased the samsung galaxy s3 from phones4u in Glasgow Sauchihall street. I bought it using the jump contract, which when sold to me sounded like a great idea. I knew the S4 would be coming out in around a years time so thought this is ideal as it allows me to upgrade my phone during the 2 year period of my contract.

the sales girl seemed very nice and while selling me the phone talked about how her boyfriend played for Rangers. how very exciting for her... little did i know this was a way for her to bypass actually giving me the true facts about signing up to the jump contract, or how she then managed to miss out showing me the important videos which apparently explained how the contract works.

this week i returned to phones4u in sauchihall street excited at the prospect of getting the much anticipated galaxy S4.. only for me to find out that caroline (the name of the sales person when i purchased the phone) had forgotten to mention some very important points about upgrading.

the main point being the cost to change phones which she somehow managed to let slip her mind. the present sales assistant arun put me on to the jump team who advised that my bill would go from £19.99 a month for my phone to just over £35 per month for my phone. combined with the sim that would take my phone bill up to £55 for the next 2 years!! for 900 minutes, unlimited text and 750mb of data errrr i think not!!!!

i advised arun that when i took the contract there was no mention of such a steep raise in the bill, at which point he mentioned the videos that i watched... what videos? i never saw a video? oh was the reply!

i then spoke to the manager gregg who has tried his best to be fair, but frankly has left me with an extremely bitter taste in my mouth with regards phones4u. he tried to see if we could buy out the contract only to find the jump contract buyout was £267 on its own, then the sim buyout from vodaphone would be another £200. he contacted head office who advised they would stump up £45, combined with the £170 for part exchange on my phone left us considerably short.

had i been advised properly at point of sale about the contract there is not a chance in hell i would have purchased it under the jump contract. in fact the way the jump contract works is completely pointless, and anybody thinking about signing up for it should think again!

gregg advised me that he believes i was mis-sold this contract. he also advised that caroline had worked for him at a different store prior to her working at sauchihall street. he found this rather strange as when he got rid of her from the first store had put on her records to not re-employ. and yet she managed to pop up in the shop to mis-sell me my phone! cracking bit of personel handling there by phones4u!

i am now left with a phone that i am paying over the odds for compared to the same contract for the S3 with other suppliers, with a year left to pay, and i would like to know what phones4u plan to do about it?

i have been a customer of phones4u for many years, but when my contract expires i will have no issue with taking my business elsewhere. I am absolutely furious with phones4u, and from looking online there are what seems a large number of other customers who feel the same way about the jump contract.

    The jump contracts were always going to end up being an expensive proposition. They were put in place to feed people's desire to have the next shiny gadget, and obviously for P4U to make money out of people's lust for new phones/
    I know that you feel you were mis-sold - but how exactly did you think that 2 brand new top of the range phones in the space 6 or 7 months was going to be funded? Surely you must have realised at some point that they weren't simply going to let you walk away with £1200 worth of phones without being stung for the priviledge?

    This is why i hate Phones 4 U on a head office level and a retail level.

    Good luck with your claim but it's not going to get you very far i'm afraid.

    with a jump contract you pay extra for the phone, and pay sim seperately. you also trade in your old phone as part of the exchange. In addition you then start the 2 year contract again from that point. the way it was sold to me was that you are then continuing to pay for the phone. it was not explained that the cost of the phone would almost double in price when you wish to upgrade. had i known that i would have said err no thanks i will keep a phone for 2 years on a cheaper contract.

    the fact is that the details of the contract were not properly explained and that certain procedures set down by P4U in selling these contracts were not followed. i appear to be one of many that has had this situation from reading their forums.

    If there was misrepresentation (or did they just "forget" to mention some key facts?) and this was a factor in you taking out the contract see:

    According to Which? remedies are damages and/or the ability to end the contract.

    Phones 4 u head office are hassle to deal with and never side with the customer.

    Taking them to court is the only way tbh. But then i don't know enough about the OP's situation to know what the right outcome should be.
