cp plus pcn ticket

Hi guys. just received a pcn for £50 (£25 if paid in 14 days)from cp plus for overstaying in a free morrisons car park after parking their for a football match.
It is my second pcn and after reading advice on here previously, I ignored the first pcn i got a couple years back and nothing came of it except the usual 6 or so letters.

Just one concern I have this time is about the new rules since October and how this changes things. i have read on it just now but still slightly confused. As my mum is the registered keeper, if i ignore it this time, all the letters will be addressed to her and am i right in thinking she would be liable under the new laws? last time they would have to prove i was driving but this is different now i believe.

I will not pay ofcourse but just wondering if it is better to take the appeals route through POPLA by suggesting the charge is excessive and does not represent actual losses to the compnay, or should i just ignore all letters from them that come in the future. And by doing this, will it affect my mum in any way as the registered keeper of the car.

appreciate any advice
thanks

You need to send a soft appeal to cp plus to take this away from your mum, something like this will do. They cannot then go back to your mum. And we can help with a popla appeal.

Can I just say that we dont endorse abuse of car parks whether private or public, try and find somewhere else to park if you do the football thing regularly

    Dear Scammers,

In regards to the invoice received with ref number xxxxxx dated xxxxxx, I deny all liability to your company, if you reject this appeal I require within 35 days a popla verification code to appeal independently, per the BPA Code of Practice.

I have nothing further to add, and will not respond to any correspondence from your company unless it contains the popla code. If you wish to find out why I reject all liability, pay the £27 plus vat to popla to find out

    Regards

thanks for that. Do i email it to them or post it? And is it alright to use 'scammers' and 'not a mug' in the letter. Lol.

Also this should mean they wont contact my mum right?

what happens if the popla appeal is not accepted, reading the recent decisions it probably should be allowed if done correctly but just incase it doesn't, what happens next?

and finally the sign says 2 hours max. And 90 mins on matchdays so it does allow parking for football except that a match usually takes 90 mins plus 15 for half time. Add in walking 10-15 mins to the ground before and after and in total you only parked there for 2 and a half hours max. If they just put the max time to 3 hours then there's no problem.

Yes alter it to the needs that you need, and yes it means that they won't contact your mum again. And I believe you can email them this, don't give phone numbers and expect a barrage of emails if you ignore them after.

Also please don't attempt a popla appeal by yourself, we know what to put into the appeals to help get a successful one for you, so come back here for further help afterwards.

I've sent the email on Saturday had no reply yet. there's no way to know if they have received it. Would it be better to post recorded delivery so atleast then id have proof they have received the appeal?

Recorded delivery isn't necessary & in some cases the recipient may refuse to sign. A simple (& free) certificate of posting from the Post Office is sufficient.

just to give an update, since emailing the soft appeal on 11/5/13 as suggested by Stroma, i have not yet received any sort of rejection from them or a popla code. It has now been 35 days since i sent it, does that mean they cant do anything now?

Also is it 35 normal days or working days that they have, to send me the rejection of my appeal and the popla code. If its working days then there's still 10 left.

Its 35 days. Within 35 days they should have contacted you to inform you they have accepted your appeal and cancelled their fake ticket or rejected your appeal, giving you a template form to appeal to POPLA and how to appeal also. Hence they can not pursue you.
