Ex Partner wants to claim on house insurance

Hi all,

My ex wants to claim on our home insurance policy of which they are named but I hold the only documents. My ex and I have a mortgage (which my ex has stopped paying). Ex is living in rented accommodation and has been for last 7 months.

My ex has asked me to make a claim on house insurance for a Rolex watch (4-5k in value) claims it is lost. As yet I have not let them have the documents.

Ex now wants to take me to small claims court or take 5k off our divorce settlement.

Am I legally obliged to let them claim?

As yet I have not spoken to my home insurer.

Ex has no idea who we are even insured with or when policy runs out.

    Check the definition of insured, if he/she is not residing with you, they may not be covered.

    Is there any harm in letting them claim and let the insurers decline it if not covered? Probably best, in any event, if you made the claim just to make sure all questions are answered accurately and truthfully.

    No offence intended, but I'm just going to come right out and say this - does ex own a Rolex or is this an attempt at insurance fraud?

    All Rolexes have a unique registration number so insurers generally only pay claims when the customer can give their insurer the number and it matches the Rolex database.

    Alternatively, some insurers will pay a claim if the customer can show evidence of ownership such as photos of themselves wearing the watch over a period of time (and not just one photo!)

    An insurer won't just believe someone who says they've lost a Rolex, there needs to be concrete evidence.

    If you suspect that there's an attempt at fraud going on then you shouldn't let ex put in claim - if you're jointly named on the insurance policy you could get into hot water too.

    SO she has moved out 7mths ago....
    When can she last remember she saw the watch? more or less than 7 mths ago.

    agree with above poster, she will need to prove she owns one... ie receipt/credit card/bank statement etc.

    tbh id tell her to slink ehr hook

    The watch is genuine, and is itemised on insurance. I just don'
    t trust ex and begrudge making a claim.

    Where do I stand legally if I don't make the claim and ex goes to small claims court?

    All you can do is be honest with your insurers, as above it could well be that. moving moved out of the insured address they will no longer be covered.

    If they are covered then I can see no reason why you need to be involved at all, your ex can make the claim themselves

    What about small claims court, would that favour them? It is a lot of if's buts and maybe's on their part.

    They would be claiming that I'm withholding the means of claiming.

    I shall find out if they are able to claim.

    As I'm not willing to, I don't believe its even lost.

    They should have ins in their new place. If you make a claim your next ins will go up.

    Wouldn't you be entitled to half anyway?

    An Insurer will look at a claim for a Rolex of any value with a very very fine toothed comb.

    It's highly unlikely if the ex does not live with you that the claim would be paid even if it has been lost.
