Virgin Atlantic/Air NZ Code Share

Hi I booked a return flight to NZ with Virgin. The return leg from Auckland to San Francisco was a code share flight operated by Air NZ.
The flight from NZ to San Francisco was delayed by over 12 hrs due to an aircraft problem. The result of this is that I was delayed by over 24 hours getting back to the UK.
I have applied to Virgin under EC Regulation 261/2004.

Virgin despite having taken my money from me have attempted to wash their hands of this case and insist that they don't owe me any form of compensation, as despite the fact that my flight had a Virgin flight number it was operated by Air NZ.

Is this right, or are they fobbing me off?

they are right - the claim is against the operating airline, irrespective of who you paid your money to or the flight number on your ticket.
As Air NZ are a non-EU airline and the flight was departing from outside the EU you cannot claim under EU261/2004.
You could try your travel insurance to see if they cover delays
