EE lied about switching!

Hi,

I'm asking for a bit of advice regarding switching broadband providers. I'll try to keep the description down to the key points for clarity.

- I went to an EE store to upgrade my mobile phone.
- They persuaded me to have a new contract and also to save money on my broadband by switching to them.
- I asked scores of questions regarding the switch because it would affect my mother's life as well as mine.
- I was advised, after the EE agent in store went to the back room to confirm with his manager, that they would do all the switching for me including calling Virgin broadband to cancel their services.
- I saw during April that my Virgin payments we being taken.
- I called EE they claim no responsibility.
- I called virgin and they had no record of attempted contact.
- I called EE again and they said they never do the switch services, contrary to what I was told.

EE gave me 2 months free broadband worth £38 as a "goodwill gesture".
I have paid £70.95 to virgin now so I'm at a deficit of £32.95.

I contacted the financial ombudsman but they put me in touch with OfCom who don't deal with individual complaints.

Have I lost this one even though I'm not to fault at all?

    why would you beleave a sales person,they lie
    its upto the person who has the contract to cancel it,not a third party
    and i think you are on a loser here
    there or their,one day i might us the right one ,until then tuff

    VM runs on a separate cable network, so 'switching' means a new ADSL service with BT/EE. There's no automaticswitch off of the cable side, the two can run together.
    It's your job to ensure that notice is given to VM and your DD cancelled after final billing-no one else can do that but you.
    No free lunch, and no free laptop ;)
