we havent got along for a while now. we used to get on a bit you know just say hello etc, and then she started having midweek parties til 4 5 am she has 3 young children and this never made a difference I work shifts and the earliest I have to be up is 330 am sometimes the parties were still going on, I tried and tried to reason with her about noise levels etc and she was appologetic the next day but went on to do it again a few days later, anyway after a lot of sleepless nights for all of us (including my 2 year old son at the time) I contacted the council / environmental health, the first man who came around agreed that the noise level was terrible and that he would come back in an hour to monitor again, I never saw him again and he never filed his report. so there was no evidence.
The council then came over to her (while she still had a load of people around from the night before) and still did not do anything. They wanted us to go to mediation I agreed but she kept on cancelling and eventually the parties died down a bit.
We have not spoken since, really until today when I noticed the bush.
I know about having to declair it when you sell, but I think I have no other option. I cant let her do this to me!! I am absolutely gutted, I know its only a hedge / bush, but I have spent hours, feeding, watering and shaping this.

If you report her to the council for anti-social behaviour, they will (or should) ask you to keep diary sheets for a couple of weeks to monitor the situation. Most councils take a fairly hard line now with anti-social tenants, so if she's still having parties, loud music etc etc then they should take action. I suppose it depends on how bad things are at the moment as to what you want to do next. Personally, having dealt with ASB before, mediation is a way of being able to close the case and pass it on to someone else to deal with to free up more time for housing officers to chase rent arrears, estate management, voids, relets etc etc etc.
You can definetly report to them about the hedge being cut down and they should investigate it, but it will probably be quicker and easier to bang up a fence on your side of the boundary and have done with. 6 foot is normally the maximum limit, but there's nothing to stop you putting some trellis on top of the fence.BCSC # 9 and proud! :beer:0 -
What you should have done is take a mobile phone or something when you went to see her and recorded her threatening conversation and her admission to cutting your hedge.
Unfortunately, it not her house (council) otherwise you could have done some damage or threaten to do some yourself !0 -
....ok I have calmed down a bit now, and yes your right I will have to declare it if we go to sell, so i suppose its not worth it in the long run. ...... anyone have any advice on where to get a cheap fence lol preferably with barbed wire running along the top!! tee hee:eek:January wins - 4 tickets for Skyrunners premier (courtesy of madmonster) 4 tickets for Charlie & Lola . If you did the above this could not be tendered in evidence for any offences disclosed, thats why there are signs when cameras are in operation.
If she has lent into your garden and cut this hedge this is then classed as criminal damage, but if it is over into her property technicully it still is crimdamage but nothing would be done.
Have you yourself planted and grown this hedge? if the answer is no then this cannot be classed as criminal damage as wildlife cant be damaged in the eyes of the law.
Best bet report it to council so they can start getting a log built up to evict her in future if more complaints from yourself and neighbours.
Hope this helps.0 -
This is an excellent excuse to prosecute her to the full extent of the law and get her chucked out if possible.
She can !!!!!! off and annoy someone else.0 -

lol you wouldnt be saying that if she moved next door to you...lol, what makes me angry is that there isnt really anything that will be done about this, they will probably have a good laugh at the council offices during t break time, but it just annoys me that she has had the cheek to do this, I would never dream of it!:A :AJanuary wins - 4 tickets for Skyrunners premier (courtesy of madmonster) 4 tickets for Charlie & Lola . It really does annoy me how apathetic and useless the government/local council/police have become. They really need to take a much harder approach on these moronic hoodie undereducated chavscum.. Anti social behaviour should not be tolerated by anyone. I hope you get things sorted soon Sylvia, good luck Sorry had a bad day lol0
