Unfortunately this is often the case and they are right if they had the keys and access to the car technically it is fraud not theft.
But they didn't have the keys, they snatched the keys from the OP. This is theft plain and simple and if the insurer will not reconsider I'd be contacting the ombudsman.

Key were left on the dashboard, insurer is First Alternative.

I'm puzzled by where the guys family went and what about the car he came in, or if he walked is he a local person?

OP If it were me I would also be searching classified ads, Gumtree and Autotrader for cheap A4s that match your car. Just incase the thief is stupid enough to sell it on through them.

That's not what was said though, what the OP said was the keys were left on the dash.

No matter what its classed as theft or fraud, the thing is he left the car open and with the keys in while somebody he did not know was looking through and round the car.

I cant see any insurance company paying out in this case without a huge court case arguing over wording of the policy, that's if you could get anybody interested in taking the case and could afford the costs involved after already loosing over 8k on a deal gone wrong.

Seizing the keys makes it theft, if you'd given them to him (unless under duress) then that would be fraud.

Complain to your insurer and if they don't play ball refer to the FOS

The keys only appear to have been seized once the OP was advised that leaving the keys unattended could make them liable for the loss.
Before this, the keys were left in the car. (that post has now been amended by the OP)

Changing what could be important information like that doesn't do the OP any favours.

Anyone else think this is starting to look like an advert for WeBuyAnyCar?

This is one reason why a cheap tracker from ebay would be advantageous along with the ability to cut the ignition.

Most cars have somewhere you can hide a tracker that would be difficult to root out. On mine I can think of plenty of places to hide one.

It wouldn't. Even if he had given him the keys the act of taking property with the intention of depriving the owner without the owner's consent makes it theft. Only if sale had been agreed could it be fraud, and even then it would be dependent on circumstance.

That said, I'm not entirely sure this incident ever happened.

What an awful story, unfortunately if the theft is made after access to the keys are given to the wretch then the insurers will not be interested.

    So sorry for the OP

Still confused ? Only "op" can clear it up . Exactly where we're the keys taken from . Similar thing happened to a contractor on our forecourt . Keys left in van , few minutes . Van stolen plus his tools . I'm afraid "op" , he did not get a penny from his insurance . He tried saying in his defence keys were not left lying around . That they were hidden out of sight . "But" , insurance kept to their decision , keys must be with you at all times . Poor bloke . The only thing op should rely on is hopefully police will find or recover his car .
