Im 'At risk' of redundancy whilst on maternty leave

I really looking for some pre redundancy advice or same related experiences.


I have been employed continuous with the same company for 14years. I have an impeccable attendance record and no grievances etc...

I have been on maternity leave since last year, I am due to return July this year. My contracted hours are 37 but I was going to be putting in for a flexible working agreement late May, I contacted Hr for a flexible working agreement application form on 09th April 2013.

But then....

on 10th April 2013 I received a letter in the post requesting my attendance to a meeting to discuss a proposed restructing of my department. I attended a week later with my other work colleagues (7 in total) we where told that our former jobs had been withdrawn and 3 new positions were created in its place ( Different roles, more responsibility, A slightly higher rate of pay)

We were all told we could apply - ( 2hour interview and a presentation was required)

In the notes it said a job share would be considered but only if proved by those involved that it could work effectively.

So here I am..

On maternity leave, requiring a flexible work agreement. Odvious that they want three fulltime member of staff ( The three have applied ), and no one wants a job share. My company say apply for the position if successful put in for a flexi - then they can look at? but really that's not would happen.

I was really confused so I thought yes I will apply and try for flexi - Then I was concerned as if I was successful in the position my flexi agreement could be turned down - Leaving me in a position to resgin Losing out on my hefty redundancy package.

I have come to the conclusion that there is not point applying- sorting out child care to organise and produce a presentation for ( how you would boost new sales and putting across" where we are as a company" along with fact figures ( Clearly me being disadvantaged as on maternity leave), putting my self through an already upsetting and anxious time - I looked at the criteria matrix and there is a heading marked Flexiblity!! Well as I have told HR and my Line manager, The healthy balance I require between work and home - I would then be scored lower than others!


I have had no response from Hr. or my line manager after I cancel my presentation slot, As I felt it was a full gone conclusion ( as three other full time members of staff applied and then me!) as I required a flexi or job share.

The successful applicants will be announced next week ( obviously the three that applied ) I have since heard that my line manager has approached another lady who Is at risk and offered her a different position within the company - She declined the offer -- i'm no employment lawyer but I very clear that my rights means I should be the first one to be offered alternative employment..

Help... Should I have been offered one of the new roles automatically?

By my line manager offering an alternative to other at risk - has she breached the law?

As im only half way through I ill be posted more with update and asking for advice.
