OP - send a PM to Cerenia (Thats me, but i'm on mum's pc on holiday currently) with the details that teh package were sent back to - I can try using the GAME lookup system, incase I can find someone, like I said, I live in loughton (Cerenia) anyway, see if I can help

The serial number on a DS lite is just a sticker and can be removed easily. or swaped to another DS0 -

I've thought of so many of these different scenarios.
i.e. She already had a broken one, and wanted to swap with my one/She knows someone in Loughton and got them to sign for it, and has tampered with the delivery slip/The other seller is someone she knows and they have done a'silent' deal where it looks like she has bought it but actually hasn't.
They just make my head go round in circles to be honest!
I have contacted the other seller and they have said that they have not had any problems with the buyer, so no help there. I have also 'spoken' with someone at ebay via their Live help, and (luckily) saved a copy of the conversation, and they have stated that they do not get involved. So another nice bit of evidence there.
The AQ doesn't have to be in until the 22nd, and I'm going to file it on the last day, just to make her wait a bit longer. Also as some have said, as the defendant I don't need to pay a fee. The woman at the court must've thought that I was the claimant.

i have just read all of this and it is a horrible situation, and i hope the truth is finally uncovered! i think the biggest hole in the buyer's situation is that she bought your DS off ebay as a present. she then bought another DS off ebay as the same present, "because paypal is faster". this is obviously ridiculous and smells like she is trying something on! i think any judge will see this is not normal behaviour and smell a rat here!

if you join which (www.which.co.uk) and pay £11 you get the full backing of a solicitor anytime of the day/year 24/7 basically. It is well worth it for their legal team. And what they dont know about consumer laws etc isnt worth knowing!
hope this helps you out, i went thru the same thing with a mobile phone where the buyer swapped the insides with a faulty unit and sent the faulty one back to me. Luckily i kept the IMEI number (*#06#) and promptly rang up vodafone and asked them to block it!!
so this woman in the end paid out £120 for a blocked phone, she threatened me with courts etc but when i promptly emailed her close up photos of the serial number of the phone and imei number all her emails stopped and the court threats stopped.
