Buyer collected in person, opens up item not as described case, now broken item!

Did he use PAYPAL? Or Cash? No comeback with cash of course. Then again collect in person , a grey area!
Ask him to return it to you, using a tracked delivery and refund the lot , if he opens a case on ebay they expect to see a tracking number, and couriers insist bikes are dismantled and boxed. It is no mean feat finding a huge big box believe me!0 -
If you had posted this, Ebay would side with the buyer.
As this was a collection item, then you have a chance.
You need to PHONE Ebay (not e-mail or use Live chat which is useless) and point out to them that this was a collection item and Ebay buyer protection is not applicable in this case.
You must phone as if you let the Ebay dispute robots decide this automatically there is good chance you'll get broken wheel back and need to refund. I assume the buyer paid with Paypal (never ever accept Paypal for collected items for future reference).0 -

one of the stickys says don't discuss open cases, not sure if that means the two parties discussing it outside of ebay or just discussing an open "investigation"
Rang Ebay this morning and i cant do anything untill 8 days are up then I can escalate it.
For anyone else interested the problem is as the headline says pretty much. Buyer collected item, few days later says its not as described and demanded a £100 partial refund, I offer a few solutions including me looking at it and now he has damaged it! and wants me to take it back or pay for repair when the item left me with the item exactly as I described it!
I will definitely never accept paypal for collection again!0 -
You are lucky he is claiming SNAD and not INR. (Assuming that is what has happened).
Be brief but concise in the case. But if you can, stress the buyer inspected and collected the item.0 -
Seller protection is cancelled, if you allowed collection in person with Paypal the payment methid as the person bxboards pointed out, and the buyer has buyer protection so will win the case. Paypal aren't likely to take your side cos they dont know all the details. The buyer is a *not very nice word that is crude and horrible goes here* but why should they get to keep the bike plus get £100 ! Nonsense. Wish you had insisted on cash or post out in a couriers van at least you'd have a chance here.

- Items that you deliver (or are picked up) in person.
- Transactions made through Zong, Website Payment Pro (PayPal Direct Payment and Virtual Terminal).

From what I understand from the brief info, this is an Ebay case not a Paypal one.
They are slightly different although I am unable to check the details as am on a device that won't allow it easily.0 -
I've not got much a scooby about ins and outs of cases, but I know they are sticklers for these stringent Terms and Conditions when the OP logs into his Paypal the money will be a minus, on hold , until the case is resolved, although if shoe was on the other foot, say you bought a bike with a wheel stuck on the sprocket or whatever bit had jammed could have been resolved by calling back the man , and bringing the bike round and the two of them getting the part off/fixed (which the OP offered to do as he knows the bike better than anyone !)
But this halfwit took the bike away bashed it with spanners sets or something and somehow he buckled the wheel or something of that ilk ,by his messing about cluelessly with it, it sounds like he had no idea how to extract the wheel from the frame etc.
Could have been easily rectified but the man seen he could get a refund, sounds like he damaged it and the big buffoon has seen an opportunity to seize to get a quick "part refund" by putting the "it arrived in unworkable condition will cost me £100 to repair it" case on ebay and being a creep.0 -
If the buyer claims item is damaged, he has admitted collecting it, so it wouldn't be an automatic open and shut case with Ebay/Paypal. I would state the case that item was checked on collection. Ebay may insist he returns it tracked.
A while ago a customer complained that an item they received was dangerous, it wasn't, they had overpaid in auction and wanted some money back. The buyer complained through Paypal, I pointed out where the same item was sold and also pointed out that the buyer had attempted to sell the item (and failed) on Ebay, so it couldn't have been that dangerous. Buyer's claim was rejected.
It's a bit of a myth that Ebay and Paypal always side with the buyer..0
