Civil Enforcement ticket help

I have just recieved a Final reminder from the above mentioned scumbags, from a fake ticket at the start of april. This is the first letter i have recieved from the,....... from THIS ticket ;) lol.
is there a generic appeal letter that i can send them?

made me laugh when i read the small print of the letter i had to laugh, mainly the highlighted bits.
Please detach this payment slip and return it with your payment. You should write the PCN number on the reverse of your cheque. The reasonable cause for obtaining your details from the DVLA is to enable the collection of fees. You may notify the information commissioner and/or the DLVA if you believe your data has been used inappropriately. in England and Wales, if you make an appeal to us which we reject, we will send you the contact details for parking on private land appeals POPLA) - the independent appeals service. It is the driver’s responsibility to pay this PCN. If you were not the driver you may pay this PCN or provide us with the name and current address for service of the driver and pass on this PCN to the driver. In England and Wales if after 28 days from the issue date this PCN has not been paid or you have not been provided with the name and current address for service of the driver, we may have the right to recover from the registered keeper all unpaid amounts due. If you are a vehicle hire firm and the vehicle was hired out at the time the parking took place, please let us know and provide a copy of the hire agreement and a copy of the statement of liability signed by you under that hire agreement. Please note that we may have the right to recover unpaid parking charges from you.

    Includes a link to show you what they did wrong with that 'Notice to Keeper' (sounds like they sent it too soon?). And also on the same Parking Cowboys website where I linked the 'Keeper Liability' info page, under 'fighting back' you will find a suggested template legal challenge letter which gives nothing away but forces it to POPLA anyway. Costs the PPC £27 plus VAT, whatever the decision - and it's not binding on you either, only on the hapless/hopeless PPC.

    Then when you get the rejection let us know because the POPLA appeal needs careful wording to win. See the 'POPLA decisions' thread at the top of this MSE parking sub-forum for info about what POPLA will accept to cancel a fake PCN like this at the PPC's expense. And the 'New POPLA Information website' sticky as well.

    didnt actually recieve the first NTK. this "final reminder" issued not even a month later:
    PCN issue 09/04/2013
    Incident: 02/04/2013
    issue date of final reminder 30/04/2013

    oh yea, forgot to mention that i wet myself at the statements "failure to pay the outstanding amount within 14 days of this notice may result in us issuing court procedings against you."

    and

    "your ability to obtain credit in the future could be affected"


    i wanna hit these A**eholes in the pocket with the popla appeal, but need a half decent "appeal" to sent them asap

    I gave you the appeal (legal challenge) to send, as advised above?! You only have a few days as the appeal clock started ticking from the first letter.

  • right, got a response from these cowboys. the expected F*** Off letter. i will try and get it scanned on at some point. i find it interesteing though, they basically told me to do one, gave me a popla number, and used the exact words
    "in the event that payment is not recieved, we will have no option but to issue proceedings against you to recover the amounts due to us. we will add our additional costs, interest and fees to the claim"

    i do hope they try to take it to court lol.

    whats my next step?

    That is utter rubbish, if it goes to popla and you win they will not have the ability to issue any claims. I would try and get this cancelled via popla first to cost them money. You can get a very strong appeal through https://www.pepipoo.com or adapt the parking cowboys one to suit you. If you decide to go there please run what you propse to send through us first, we may be able to tweak it for you.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

  • it was basically the parking cowboys letter i sent to them first
    im half tempted to bring into play the bit i put in there about a £25 charge per letter sent and recieved, and by them replying, they are accepting this under the same contractural law they are trying to play lol.

    Well if it goes to popla and you win, you could in theory issue a claim to them, it would be interesting to see if they would defend it lol .They are not in my area at all from what I can see, would love to have fun with them
