currys sold me a used tv as new

Hi All,
I purchased a Samsung 46 es7000 from currys Ipswich the tv was on display but was sold to me on their 10 plan as new it was not in a box but the staff wrapped it in bubble wrap and handed me a standard remote control a standard Samsung tv manual 2 pairs of 3d glasses and an ibr blaster for at £999.97 the price advertised for the tv on the website when I got it home I discovered that it was already set up for the channels and when I went to the smart tv hub found that face recognition and the pin were already set up by someone else with their login details I emailed the person and they said they had purchased the tv several months earlier had used it for a few days then returned it to currys for a refund as you can imagine I am extremely disappointed and feel cheated that the tv I have been sold is second hand and not only been used by the previous owner but was also on display switched on in the showroom for how ever long before being sold to me as new not only that the salesman was so insistent that I took out the extra care plan because the smart remote control would cost a lot of money to replace if it became broken and they never even gave me one to start with can someone please advice me of what I should say when I telephone them many thanks in advance

Obviously if you're buying it off show and it's been switched on etc then it's not new, and if that was just the case then basically you knew that when you bought it, and that would be that, but, having found someone else's details on there, well, that changes everything. Currys should have noted on the ticket that it had been "previously sold", and if they didn't then that is just wrong, I'm sure by law they have to advertise the fact, and it should have also been reduced to take this into consideration, as I'm sure they will have charged the previous owner a Re-Stocking Fee....at least they should have done.

Go back down to the Store and ask to speak to the manager, explain the situation and tell him you want a refund or an exchange for a different tv.

If however it did say on the ticket that it had been previously sold, then they'll say that you knew at the time of purchase and it'll be up to the discretion of the manager on duty at the time.

Also, even if the Salesman was insistent that you take the extra care, you didn't have to, the decision was ultimately yours, and you do have so long to cancel it if you do change your mind.

How did you think it was new if you were getting a display model?

I'd much rather have a TV that had been briefly used and returned than one that had been showing a looped demo for days, weeks or months and had various mucky customer paws on it, but you were seemingly satisfied with the latter so I don't understand why one more person using it makes a difference?

They use to sell the returned tvs as Managers Specials when I worked for Currys.
  • there was no mention that the display tv was the one I was getting until after it was all signed for and the salesman asked for someone from the warehouse to get the tv ready to be put in the car that is when I got handed the manual and other bits as I was sitting in the car and the tv was bubble wrapped and put on the back seat it was only after I had got the tv home it twigged that the tv was not new and had not only just been taken out of the packaging for easier transportation but that it had infact been sold before and had the smart remote missing so in answer to your statement that I was seemingly satisfied I was when I thought I had purchased a new tv and the added insult was finding out that it wasn't just an ex display model but had even had been in someone else home first with their own pin and face recognition put into it then for just under a thousand pound I can assure you I was extremely dissatisfied with the purchase and that is why I am asking for advise and not criticism on here

Have you asked for a refund?
    What does the receipt say?

Hang on, you say you saw them take it off display, then give it you... yet you didn't realise it was ex display?

    .

Pippa - Can you see that small thing at the top-left of this post? It's called a full-stop - you may wish to start using them. ;)

Just take it back and explain you either want a new TV or a full refund.
