Am not a lawyer but I do know its illegal to advertise an item as new online and the buyer has no chance to examine it, so trusts the description given on on a site of repute ie ebay, so to sell a new item and then post out a burnt and damaged broken item to an unsuspecting person ,IS against the law. The payment was refunded by the seller not reversed , the buyer sent a polite email voicing their concerns and the seller cacked it and realised they were in deep doo doo so why someone would defend a low life who does that is beyond me, I would be also questioning the seller if I had received the item, this is a new buyer who has asked what to do next. I was correct by saying do absolutely nothing. Nothing has changed since my first reply. The seller was a scammer and law breaker. Not the buyer. Just someone after a bargain who got conned.NB...People online who are here asking advice for "my friend" they really mean "myself" :eek:0

I think you're misunderstanding. I didn't "reverse the payment". I sent a message, which opened a case. The buyer then chose to refund. The case was then closed.0 -
So, you really have a couple of choices ....
Do nothing,
contact Ebay/paypal
contact the seller.

Can you just clarify, this is definately a refund from the seller? eBay sometimes fork out in cases like this especially where it's very costly to send back.Warning: any unnecessary disclaimers appearing under my posts do not bear any connection with reality, either intended, accidental or otherwise. Yes, it's the same email address I sent the payment to.
"Good news. We've informed the seller that the item wasn't as described, and the seller has issued you with a full refund. This case is now closed."

Well, after two more chats with the people at the live advice chat - and an email from the resolutions team, I got so fustrated that I rang up. A two minute phone call later with a guy named Jeff and he told me that as the seller had automatically refunded me and the case was closed then I should take no further action.
Lesson learned, if you want any advice from eBay - ring them!0 -
