Live Chat Advice Question.

Sorry about this folks but I just wanted to check the advice I was given by eBay live chat. (I've never had to request a refund before, so please be patient!).

I bought a guitar off eBay. It arrived and was not as described (the plastic holding the strings has snapped, there is paint all over the frets, and there is a sizeable mark on the wood that looks like a burn). I went to send an email to the seller to inform them off this and asked for a refund. Unfortunately this automatically opened a case - something I didn't really want to do, but apparently it's a new system?

Anyway, I received an email today from PayPal telling me that the item had been refunded and eBay messaged and said the case was closed. Now I have no idea about this new case system - I thought I was going to have to send the item back to the seller, but I've had no information about how to do that I'm worried that if I message them again it'll open another case. I've sent a message to the email from the cancellation address but had no response yet.

Apparently my best bet is to "call the seller" and ask what they'd like me to do. Obviously the guitar is heavy and bulky and I have absolutely no idea how I'd send it back - or even if they want it back (I'm sure they probably do) - so any advice on what to do next?

    A computer "told " you to call the seller everyone gets those messages when ebay are done with a case!

    You need to "do" absolutely sweet nothing , no more comms to the seller, just leave it and get on with your life.....it was an unwanted broken contraption and without argument and out of niceness, they have given you the full refund that you requested, as far as ebay goes, you are free to do what you so wish with it .
    Should the seller want back some tatty old guitar (unlikely) then they would need to arrange that themselves , but as far as am aware, it was knackered on opening so there is no more to say, you own it therefore, you can repair it, use it, donate to charity, keep for spares and repairs and are under NO obligation to send it back unless the person had any use for it and was actually paying you for a courier and the packaging costs.

    Just click yes I agree to cancel the transaction and then they get their fee back but sounds like they know damn well they sold you a crock when they didnt even try and defend themselves :O hehe

    Surely if you buy something, and then the payment is reversed, it's not yours any more, and the seller could sue you?

    Don't mistake ebays rules for the actually law.

    Do sellers just loose the money in cases like this and have to persue the buyer or paypal through the courts to get it back?

    The buyer has a broken item and paid for an unbroken item, in my day no one sued anyone on ebay, hardly think anyones going to send two burly policemen round to collect a broken musical instrument, in the olden days, people just flung stuff in the bin. Bothering a lawyer "sueing" to get back their burnt guitar that cannot be played as the string/ frets and other structures are absent , er no don't think so, who would benefit , the guitar is not as described, dangerous probably with sharp bits protruding, all ebay is , is an online jumble sale portal for people to get rid of unwanted stuff , the guitar seller was probably someone who found it lying in a skip to begin with !

    But you can't just reverse the payment for stuff just because you don't like it, that's stealing.

    I didn't reverse it because I didn't like it - it's broken and essentially unplayable. Considering it was advertised as new, it's also not what I was expecting.

    I think I might ring eBay in the morning and have this cleared up. I would have thought that if the seller wanted it back they would have sent me a message or contact details or such but that hasn't happened. Like I said, I don't want to contact them and end up opening another case.

    Politeness , would, IMHO dictate that you should consider asking the seller if he wants it back and is prepared to pay to do so.

    If he indicated either way, or does not reply then that helps to solve your problem.

  • I doubt very much anyone will be banging on the fellas door soon accusing him of theft , he won and paid for a nice guitar to play a tune on, and received instead some paint splattered, fret frazzled, burned up unplayable guitar, he bought a guitar to play but will probably get a better tune out of his original old air guitar, they sent boos money back without quibble or counter-argument , and hardly a collectors piece is it ?

    DONT BOTHER TO CONTACT a) ebay OR b) the seller why its pointless, ebay dont want to know-they already sent the robot email saying, its between the buyer and seller was their final say on the matter, seller refunded without saying anything in his or her corner, you dont need to do anything else, the case is closed, so why waste any more time on this? You arent getting sued, the jail , or breaking any law just forget it, and move on. If anything, the seller should be the one facing neg feedback and warning others they are a con artist! Item was not as described. "New"? When ? In 1972?

    I wonder if Van Halen gets this sort of hassle LOL?
