SN Brussels

I had made use of the letter template to seek compensation from SN Brussels for a 24 hour delay on a flight in 2011(following the article on Martin's TV show) believing that the 6 year period of liability was applicable. SN Brussels have claimed an ancient law of 1891 states that the EC regulation of 2004 can only be carried back 1 year. Any advice?

    have a good read of the FAQs then write again before issuing count proceedings (assuming there is a valid case and you are prepared to do this)

    They are talking nonsense and a number of the airlines (if you read the threads) are doing anything they can to avoid payments I guess hoping that people will give up (= they save money) you may have to be prepared to court but plenty information on these boards
  • I was travelling from Banjul, West Africa to Newcastle upon Tyne via Brussels. SN Brussels seem to have acknowledged the potential viability of the EEC legislation but state that their Belgian laws that 'matters relating to carriage of persons' from 1891 and state:'all actions that are resulting from a contract of carriage of persons and for which no other law or international Convention is applicable are subject to this law and consequently time-barred after one year'. Is this another case where we Brits apply too much obeisance to EEC law but our European neighbours only follow the bits convenient to them?

    The court decision said quite clearly that the rules of the individual countries apply regarding time limitations
  • You are entitled to bring your claim in the UK since the flight arrived in Newcastle. The applicable time limit is therefore that which applies in Eng/Wales which is 6 years. Issue a claim using the European Small Claims Procedure form A.

    Thank you Centipede, this procedure suggests it is for amounts of 2000 euros or less, there were 3 other passengers travelling with myself so I had claimed 2400 euros. Would I be better to claim 500 euros each or make 2 separate claims of 1200 euros on behalf of the family?
