DFS rejecting PPI claim

Hi.
After paying off my loan for a sofa from DFS i received a summary letter from HFC Bank showing my monthly PPI payments over the 3 years i had the loan.
It wasn't until all this stuff hit the news that i decided to check my paperwork and realised that the PPI box had indeed been checked. At no time during the sales proceedure were we told that PPI was optional (naiive of us maybe to not know this) and we were given our monthly amount to paid, which included the PPI. Had i known that it was optional i would have refused it.

DFS have told us we were not mis-sold as at the time we did not have cover should we become unable to work. They are conveniently ignoring the fact that we had sick pay from work, a family member who could help us and the fact that we told them we had plenty of savings to cover the loan should we need it.

I thought the fact that we weren't given the option to refuse the PPI meant that it was mis-sold? Any advice for me please?
Thanks.

Your savings and sick pay should have counted towards your ability to repay, but you would have need to be able to repay for a year.
A family member helping makes no odds.
If it was post regulation, refer it to the FOS. If it was pre-regulation, you can try complaining to the insurers, but there you'll be extremely lucky to get anything back.
    When was it sold?

  • It was sold to us in July 2007, does that help or hinder us?!

Helps, you can refer it to the FOS.

  • Thanks -taff.

Can you tell me the process... i just go ahead and write to the FOS stating my issue as i wrote above? What do you think the chances are of the FOS upholding my claim?

No idea. You will have to fill in the above form, and send a signed copy of the form you sent to DFS.

Hi did the letter say anything about contacting Andrew tweedale if you were still unhappy? if so phone the number above up and ask for him to review the case as I have.

    My story with DFS

Me and My husband bought our first ever sofa from them in 1996 as we were new to all this interest free credit stuff we was taken in by the sales person to cut a long story short he filled in the form ticked the PPI box and when we asked what the extra charge was for he told us it was like a admin charge basically because the company gave you 4 years interest free and us being stupid and young and never had bought anything on credit before we believed him it wasnt until 6 years later when we went back to DFS for our second sofa that the sales person explained what PPI was and gave us a choice to which we said no , we was a little mad that we had been ripped off but was only a couple of hundred so let it go until I put claims in with others who added PPI without my say so,

So write to them again but be warned DFS are not very good at dealing with this my case has had a lot of errors and I am still waiting to hear from andrew tweedale .

First they said I didnt have PPI (even after sending the invoice)
then they didnt log my complaint
then took 2 months or more to say no
so I asked for it to be reviewed by Andrew
then got the same no letter so phoned them up and it had not even been passed to Andrew.

    Good luck
