It was a 4 lane road with a bus lane at each side.
In Simons statement to the police he says that the green man was on when he stepped into the road. When he was in the bus lane the lights started flashing so he quickened his pace.
The witness says the lights were flashing when Simon stepped on the crossing.
I have just read the witnesses statement.
He is a young man in his early 30's.
He states that he was waiting to cross the road on the opposite side to my partner
.
He says he pressed the button on the Pelican Crossing and waited for the green man to appear before proceeding to cross the road.
He states that when he was 90% of the way across the road the green man started to flash.
He says that he passed by my partner in the bus lane which was the 1st lane on my partners side of the road.
I would think the crossing would need to give a longer crossing time if it did not give a young man time to cross before the lights began to change?
My partner is adamant that the green man was not flashing as he stepped on to the crossing.
Could we use this as as case for appeal?0 -

If possible could you go and measure the time it takes to cross the entire crossing and then to the 90%.
Do the timings in a fair way so you don't walk too slowly or to quickly. Perhaps you could measure the time it takes three people to cross and use the average of these.
Also measure how many seconds the green light is on.

If I was waiting to cross and stepped into road just before the green light started flashing then I would have gone back to safety rather than try to cross 4 lanes before the lights changed.0

When driving if the amber light is flashing, you MUST give way to any pedestrians on the crossing.

thank you for your good wishes.
My partner has not recovered from his injuries and that is the main problem with this.
He is scheduled for surgery on 29th january. We are hoping and praying that this will help and that he will be able to get back to work.0
